MAGISTRATE’S COURT Man reported to police after returning from Australia

Peter John Gibson, aged 22, a builders’ labourer, yesterday pleaded guilty in the Magistrate’s Court to charges of assault, resisting arrest, escaping from custody, wilful damage and breach of probation. He was remanded in custody to October 20 for sentence by Mr W. F. Brown, S.M. The charges were the result of an incident that took place in Cathedral Square on May 31 last year. Gibson appeared in Court on June 4, 1969. and pleaded not guilty to the charges and was remanded on bail for two weeks. Gibson failed to appear on bail and it was later learned that he had gone to Austra-* lia, said Sergeant M. Morresey. He returned to Christ-' church a week ago. reported to the probation officer and gave himself up to the police, who executed a bench warrant for his arrest. At 120 a.m. on May 31 last year Gibson struck Raymond James Whitla, who was standing talking to a friend in Cathedra] Square, said Sergeant Morresey. Gibson was located by the police soon afterwards. When he was being put into a police car he made off. When Gibson was caught again he resisted violently and when being placed in the cells at the police station he struck two constables in the face and damaged a tunic. FURTHER REMAND A woman who took her children shopping so that they might steal for her and who was to have been sentenced on six charges of theft and one of receiving, was further remanded on bail to October 16 to enable a supplementary probation report regarding the situation of the woman’s children to be obtained. The woman last week pleaded guilty to the charges. One charge to which she pleaded not guilty was yesterday withdrawn at the request of the police. The woman’s name was not suppressed but the names of her children were suppressed when they pleaded guilty to charges in the Children’s Court. She was represented by Mr D. M. Palmer PERIODIC DETENTION A sentence of six months periodic detention and 18 months probation was imposed on Albert Eric Lye, aged 23, when he appeared for sentence on a charge of stealing a motor-cycle worth $4OO from Geoffrey Paul Walker on October 2. The Magistrate said the defendant had stolen the motor-cycle from a student. He had then stripped it of parts. The defendant had previous convictions. The question of the amount of restitution the defendant should pay was reserved after deliberation. SENTENCED FOR THEFT Appearing for sentence on a charge of stealing a jacket worth $49 from Richard George Perrott on October 7, Whare Maraki, aged 20, a showmill, was placed on probation for one year and ordered to live and work as directed, and fined $4O. PERIODIC DETENTION Harry Wharepouri Bert Edmunds, aged 26, a moulder, was ordered to attend the periodic detention centre for five months when he appeared for sentence on a charge of stealing property from cars on October 3. REMANDED On a charge of operating a broadcasting station illegally in Christchurch on April 5, Barrie William Morrison was remanded on bail to October 16. No plea was taken. “MEAN THEFT” Thomas Sydney Brown, aged 48. unemployed, was further remanded in custody to October 16 for sentence on a charge of stealing a radio and other goods worth $lO3 from the house of H. C. Browning on August 10. The Magistrate ordered a medical examination to see -f the defendant was fit to undergo periodic detention. The theft was a mean one,; committed when the defendant. had been given the use of the ; house, while the complainant' was away, he said. RECEIVING CHARGES Gordon Herbert Roxburgh, aged 29, a panel beater, was convicted and remanded on bail to October 20 for probation report and sentence on two charges of receiving stolen articles. Roxburgh (Mr H. J. B. Quigley), pleaded not guilty to receiving a valve facing machine valued at $235 between December 3 and March 31, and motor accessories worth $l5O between August 3 and September 16. Evidence was given that the valve facing machine had been stolen in a burglary at Timaru and the motor accessories stolen from a parked car in Christchurch. TWO BURGLARIES George Ronald Collier, aged 21, who was to have been sentenced on two charges of burglary, was further remanded in custody to October 16. Crutchley, SJtf.) NARCOTIC OFFENCE “Two medical certificates say you are a drug addict and need treatment. You have a similar conviction and have been in detention centre. In your own interests, there will be no penalty at all,” said the Magistrate before ordering Geoffrey Arthur Proctor, aged 17, an electrical serviceman (Mr G. R. Lascelles), to be detained for treatment under the Alcoholics and Drug Addiction Act. The defendant was appearing for sentence on a charge of possessing a narcotic. He pleaded guilty. $6O FINE AND PROBATION “You made a swing of the knife and this would justify the Court in imposing a strong penalty, but the probation officer’s report says that this was an impulsive act and you did not intend to use the knife,” said the Magistrate before imposing sentence on Keith Arnold Rankin, aged 19, a machine operator. He pleaded guilty. The defendant was fined $3O on a charge of assault and $3O for using obscene language. Two years probation and a prohibition order were also imposed. “It seems you have suffered some epileptic disability and there is nothing to suggest you were responsible for the initial trouble,” said the Magistrate. DEPOSITED RUBBISH Stanley Bevan Learning, who left a trailer-load of rubbish, including felt, cotton waste and trees at Halswell Junction Road because the trailer wheel had a puncture, was fined $3O.
