’ ' ; .J < i f Dismissal Of Appeal (N.Z. Aswofstfon) ; WELLINGTON, August 25The Court of Appeal‘today dismissed an appeal by New Zealand Industrial Gases, Ltd, against Andersons, Ltd. Andersons brought • «n action against N.E.I.G. for $57,000 damages, claimed to have been suffered in a Are lb 1962. In 1968 N.Z.I.G. moved to strike out the claim Mr Justice Witoon. ■ Appealing against the judge's decision, N.Z.I.G. claimed that it wag Anderson’s responsibility to press on with the case, hut : the company had not done go. The Court of Appeal held that the appellant had felled to establish material prejudice to its defence.
