MAGISTRATE’S COURT Man Sentenced To 15 Months Gaol On Nine Charges

John Ola Paulsen, aged 24, a machine assembler, was sent to gaol for 15 months when he appeared before Mr H. J. Evans, S.M., in the Magistrate’s Court yesterday for sentence on two charges of unlawfully taking cars, one of unlawfully interfering with a car, three of theft, two of wilfully damaging a car, and one of unlawfully getting into a car. Mr R. F. Powell, for the accused, said that there was no excuse for Paulsen’s behaviour. Alcohol was the catalyst in all the offences and Paulsen appreciated the effect liquor had on him and intended to seek treatment for his disability. Paulsen intended to marry the girl who was pregnant to him. His divorce had only recently come through. He had been given every chance and assistance, Mr Powell said.

The Magistrate said that Paulsen had a number of previous convictions for serious offences and had served prison sentences. In January he had been sentenced to nine months in the adult periodic detention centre for burglary and the present offences had been committed while he was attending the centre. He had twice committed offences while on probation. Paulsen was sentenced on charges of unlawfully taking a car valued at $3400, the property of Carthy Motors, Ltd, a car valued at $5OOO, the property of Thomas Gibson, unlawfully interfering with a car valued at $llOO, the property of Jack William Baggley, unlawfully getting into a car valued at $9OO, the property of Murray William Steele, wilfully damaging a car window and radio aerial to the value of $25, the property of Robert Donald McKenzie, wilfully damaging an aerial to the value of $lO, the property of John David Hunter, stealing a camera valued at $36, the property of Eric Bruce Holland, stealing a transistor radio, watch and groceries valued at $57, the property of Noel Bruce Hazeldine. and stealing a suitcoat and other property valued at $75, the property of Robert Donald McKenzie. Phillip Anthony Griffiths, aged 18, a sign assembler (Mr B. C. Taylor) was fined a total of $l4O, was ordered to pay Court costs of $l5, and to make restitution of $19.50, was admitted to probation for a year, ordered to- live and work where directed and not to associate with persons not approved of by the probation officer. Griffiths was appearing for sentence on charges of unlawfully taking a car valued at $5OOO, the property of Thomas Gibson, a car valued at $3400, the property of Carthy Motors, Ltd, and stealing a suit coat valued at $4O. the property of Robert Donald McKenzie. Mr Taylor said that Griffiths had not damaged either car. The had been done by his co-offender, Paulsen. Griffiths had been led into the offences by Paulsen. Griffiths came from a disturbed family environment He was a first offender. The Magistrate said that Griffiths had played a lesser part in the offences titan Paulsen. He refused an application for suppression of name. DISMISSED Submissions by counsel that there was no prosecution evidence to show that two girls found In a ship had secreted themselves lor the purpose of going to sea were upheld by the Magistrate. He dismissed charges against Patricia Anne Conlon, formerly Patricia Anne Hawtin, aged 19, an unemployed nurse, and Wendy Patricia Osborne, aged 17, a waitress, of being found in the m.v. Essex at Wellington on July 2 without the consent of the owner or master. They pleaded not guilty and were represented by Mr G, T. Mahon. Senior-Sergeant F. G. Mulcare said the defendant Hawtin had married since being charged. Evidence was given that the two girls were found in separate cabins after the ship had cast off at Wellington. Thev were arrested on their arrival in Lyttelton. Both girls told the police that they had visitors' passes but went to sleep in a cabin before sailing time. Their boy friends had gone on duty and had forgotten about them. The charges were dismissed without evidence being called by the defence.

BURGLARY Jan Dean Gerrand, aged 24, an unemployed showman, was convicted and remanded on ball

t<j July 30 for sentence when he pleaded guilty to a charge of breaking and entering the building of Hornby Dry Cleaners on June 27 with intent to commit a crime.

TOOK BEER TANKER Charged with unlawfully taking a truck valued at *BOOO, the property of New Zealand Breweries, Ltd, Gary Warren Dennis Lewis, aged 21, unemployed, pleaded guilty and was convicted and remanded on ball to July 30 for sentence. The accused had admitted that he and another man had climbed over a fence into a yard in Sandyford Street where they found the truck with the ignition keys in it, said Sergeant The truck was driven through the wire mesh fence, causing *455 damage to the truck and *250 damage to the fence. The accused said he had come to hla senses when they got on to the road and had abandoned the vehicle. He had been drinking most of the day. PROBATION "The Court can reasonably take the view that probation Is a proper sentence,” the Magistrate said when releasing Brian Desmond More, aged 22, a shoe maker, on probation tor one year on a charge of unlawfully taking a New Zealand Breweries truck valued at *BOOO on July 6, He had previously been convicted. The defendant was ordered to make restitution of *352 and pay *2O towards the costs of prosecution. Mr G. R. Lascelles, for the defendant, said the offence was a particularly foolish one. Where he was going or what he was doing with a brewery waggon was not known. The defendant had a good work record but unfortunately had had too much to drink. DETENTION Gavin Edgar William Kinsman, aged 42, a press hand (Mr R. J. Allan), was sentenced to periodic detention at the Brisbane Street centre for nine montbs when he appeared for sentence on seven charges of theft. He had previously been convicted. The defendant was ordered to pay restitution of *14.43.

TOOK TRAILER Charged with unlawfully taking a trailer valued at 1150, Peter Owen Brown, aged 17, a clerk, was convicted and ordered to come up lor sentence within 12 months if called upon. He was ordered to pay *5 Court costs. Brown pleaded guilty to taking the trailer.

Sergeant Burrell said the accused had admitted taking the trailer, the property of the Christchurch Gas Company, from where it had been parked on the roadside in Hills Road. He and other youths, who had already appeared in Court, had abandoned it near the Shirley golf course. The accused said they had been drinking and "did it for a laugh." Mr E. T. Higgins said It was a foolish prank that backfired. The defendant regretted the incident. OBSCENE LANGUAGE SJoard Van Tuinen, aged 23, a butcher (Mr I. James), was convicted and fined. *lO on a charge of using obscene language in the car park of the Blenheim Road Motor Inn on July 5. He pleaded guilty. Sergeant Burrell said the police had cause to speak to the defendant. As the defendant was walking away he used the language complained of.

IS MONTHS PROBATION "You’re on the brink of Imprisonment,” the Magistrate told Robert Anthony Heath Pearson, aged 22, unemployed, who was appearing for sentence on charges of theft, wilful damage and driving while disqualified. A period of six months adult periodic detention and IS months probation were imposed on the accused on a charge of stealing bedding worth *76.65, the property of George Athol Mcßeth, between March 20 and April 12; wilful damage to a Post Office telephone on April 5; and driving while disqualified in Seaview Road on April 24. He was further disqualified from driving for 18 months and ordered to pay $21.97 restitution. A special condition of probation was that the accused take medical or psychiatric treatment as directed by the probation officer. In mitigation, Mr M. J. DISQUALIFIED Noel Deane Trembath, a workman. aged 19, was fined a total of $132. with $2O Court costs, and disqualified for three years

and a half, when he appeared on two charges of driving in a manner that might have been dangerous, a charge of inconsiderate parking and a charge of obstructing a traffic officer. He pleaded guilty to all offences, Trembath parked 15ft from the kerb on March 31 to speak to friends. On March 27 he drove across a pedestrian crossing in Cathedral Square about 10.50 p.m. His speed was estimated at 30 ni.p.h. and the car was still accelerating when the offence occurred. About seven pedestrians had been on the righthand side of the crossing at the time, and others were on the left. On April 23 Trembath drove around Cathedral Square, broadsiding 32ft at the southern end of the bus zone. At the northern end he had broadsided 44ft. At the time he had told Traffic Officer J. Almond that he drove in that manner “for laughs.” He had given the officer a false name and address because he had already had a ticket for dangerous driving and did not want another.
