Milk Bottle Incident Leads To Shots
(New Zealand Press Association) AUCKLAND, April 28, The Supreme Court was told today that a man fired at two youths and injured them after money had lieen taken from his milk bottles.
Joseph Maunseil, aged 51. a shop assistant, pleaded not! guilty to three alternative charges. He is charged that on No-i vetnber 3 last year he dis-j charged a firearm with intent to injure Johnson Marsh and Allan Brian McPhee, that he discharged a firearm with reckless disregard for the safety of others, and that he injured the two youths under, I circumstances that if death! had been caused he would (have been guilty of manslaughter. The trial is before Mr Justice North and a jury of eight men and four women. Mr C. M. Nicholson appears for the Crown; Mr P. A. Williams appears for Maunseil. Mr Nicholson said that on Sunday evening. November 3 last, some youths were walk-
. ing along a street in Freemans Bay. 1 A girl in the group took some money from milk -bottles on the accused's •j veranda. ! The accused shouted after [ her but she went away. She ! went to a hostel where she J saw the two youths Marsh ’ and McPhee. ;i She gave the money to ' them and they started back, ' 1 to the street to return the 1 money to Maunseil. Evidence would be that they saw Maunseil but as they - approached him he fired two I shots at them. Marsh received . two wounds to his head and ila pellet was later taken from •! one wound. McPhee had an abrasion. r Police visited the accused’s I (home and took possession of -|a double-barrelled shotgun.
