New Hearing Refused

HAMILTON, April 10.

A move for a re-hearing of New Zealand’s largest damages claim has been dismissed by Mr Justice Perry. John Francis McDonald, a sales supervisor, of Wanganui, was awarded $78,462 after a 10-day hearing at Hamilton last November. He suffered serious injuries in a collision between his car and a truck driven by Kenneth Graham Bunn, of Cambridge, near Te Kuiti in 1964. The respondent moved for a new trial on the grounds that the judge admitted improper evidence relating to the speed of the respondent’s vehicle, that the jury should have found McDonald and Bunn equally responsible for the accident, and that the general damages were excessive.

His Honour, ih a written decision, said he could not uphold any of the claims.
