MAGISTRATE'S COURT Man Sent Back To Gaol For Failing To Report

“I failed to report on principle Harold Ashton Woods, aged 53, a labourer, said in the Magistrate’s Court yesterday when pleading guilty to a charge of failing to report to a probation officer on January 31. “Dp I understand you to refuse to report?” asked Mr P. L, Molineaux, S.M. “That’s right,” said Woods. “In that case I will sentence you to imprisonment for seven days,” said the Magistrate. A probation officer said that Woods was released from prison after serving a term of preventive detention and was required to report to the probation service each Friday, but failed to do so.

“After I have done 11 years I feel I have done enough,” said Woods. “The probation service has done nothing for me—they are not paid to do anything;” Woods asked the Magistrate what was the purpose of reporting and suggested it was just a formality. “The philosophy of the probation service is not to be determined within the walls of this court,” said the Magistrate. 1

CISTERNS STOLEN Charged with stealing two copper cisterns worth $20.96, Rodney Neil Harris, aged 17, a painter (Mr D. M. Palmer), was convicted and remanded on bail to March 19 for sentence. He pleaded guilty. On the afternoon of February. 7 two youths were seen tq go into public toilets at New Brighton and come out soon afterwards carrying a copper toilet cistern each, said Detective Sergeant B. J. Preston. The police arrested the youths in Christchurch the same afternoon. Harris admitted the offence and said the cisterns were sold to a scrap-metal dealer for $4-60. The other youth was to appear in another court. UNLAWFULLY ON PREMISES Charged with being found without lawful excuae In the Clarendon Hotel. Martin Joseph McLoughlin, aged 29, a booking clerk <Mr G. T. Mahon), was convicted and fined 920. He pleaded guilty. McLoughlin entered the room of a guest in the hotel without knocking at 11 p.m. on March 11. When the guest said he did want company McLoughlin left and the manager later found him on another floor.

Mr Mahon, said that McLoughlin had been drinking at a function and had no clear recollection of what had occurred. There Was no sinister motive in his actions.

FINED AND DISQUALIFIED On a charge of - driving in a dangerous manner, John Smith, aged 21, a shop assistant (Mr D. H. Stringer), was convicted and fined 950 and disqualified from driving for one year, and oh a charge of falling to stop at a sign he.w,as fined 920 and disqualified for one month, the terms to be cumulative. Smith pleaded guilty. A police patrol saw Smith riding his motor-cycle tn McFaddens Road at 10.29 p.m. on January 14. He crossed Rutland Street at 20 mites ah hour, falling to stop at the stop sign, said Detective Sergeant Preston. His speed in McFaddens Road was checked at more than 40 miles an hour; FAILED TO REPORT On a charge of failing to report to the periodic detention :entre on March 1, Michael John Harris, aged 33, a fruiterer, was ,-onvicted and fined 940. He jleaded guilty. Harris said he had been away for the day on business and had got back too late to report. "It is not a question of going along when it is suitable to rou,” said the Magistrate. “If 'ou act in defiance of the Court vou will find yoursetf in gaol, and this policy will be followed on the instructions Of the senior magistrate.” STOLE PETROL On a charge of stealing two gallons of petrol worth 70e from Laurence Carter on November 2. a youth, whose name was suppressed (Mr 1. C. J. Polson), was convicted and ordered to come up for sentence in six months if called on. He pleaded guilty. REMANDED Barry Pakau, aged 22, a forklift driver, was remanded on bail to March 19 on charges of carrying a shotgun without lawful excuse at Lyttelton on March 11, and carrying a pistol when not having a licence to do so. No plea was taken. Mr R. B. Leete asked for the remand to enable medical reports to be obtained. MISCELLANEOUS CASES In miscellaneous cases brought by-the police, convictions were entered and penalties, Imposed as follows, with costs of 95 in each case:— Careless use; S. R. Harper, 920 and disqualified for one month; O. G. Laing, 915. Failed to give way: K. J. Gray. 915. and disqualified for three months; E. L. Fox, 912. Exceeded 30 m.p.h.: G. W. RECKLESS DRIVING

A youth who cut two corners at high speed while being chased by a traffic officer, swerved to the wrong side of the road and hit the gutter, was fined 960 and disqualified for two years on a charge of reckless driving. John Clifford Linton, aged 18, an apprentice panel-beater (Mr P. J. Cordner), pleaded not guilty. Evidence was given by TrafficOfficer J. P. Bowcock that he chased the defendant at 50 miles an hour down Hagley Avenue on the night of December 19. The defendant passed another car on the left and then made a sharp turn, into St Asaph Street, careering over to the incorrect side of the road and hitting the gutter. He then made another sharp turn into Stewart Street, swerving over and hitting the gutter again. The defendant pulled up in Stewart Street, turned off ' his lights immediately and crouched down in the front seat.

The Magistrate said that Linton said in effect that almost the whole of the traffic officer’s evidence was lies.

"1 find both the defendant and a witness who was in the car with him to have been evasive and unreliable,” said the Magistrate.

FINED $25 John Winston Wingfield, aged 31. a contractor (Mr H. J. B. Quigley), was fined 925 on a charge of exceeding 55 miles an hour on the northern motorway on December 29. He pleaded not guilty. FINED 918

CHARGE DISMISSED A charge against Stephen Robert Foster, aged 18, an apprentice carpet-layer, of using obscene language in Harrow Street on December 21 was dismissed. Foster, who pleaded not guilty, was represented by Mr M J. Glue. Evidence was given that obscene language was used in Harrow Street on the evening of December 21 after a car containing a number of youths broke down. Foster said tn evidence that the obscene language was used by another youth. CARELESS DRIVING Keith William Rowe, aged 20, a storeman (Mr Z. Maciaszek), was fined $lB on a charge of careless driving. He pleaded not guilty. Evidence was given that the defendant had struck the rear of a police car double parked in Colombo Street shortly after 11 p.m. on November 29. Convicting the defendant, the Magistrate said that although the police car might not have been perfectly parked, the driver had left the parking lights on. The defendant failed to keep a proper look-out. DISQUALIFIED DRIVER Appearing for sentence on a charge of driving while disqualified on January 12, Brent James Childs, aged 17, an apprentice carpenter (Mr I. J. S. RceVes), was fined $5O and the period of his disquallflcatioti was extended for three months. Mr Reeves said that a friend rode Childs’s motor-cycle to Woodend but because of an injury to his hand was unable to I ride it back. Childs volunteered to ride the motor-cycle back and was stopped bv a traffic offi- ; cer. Childs could not have received a better probation officer’s report and because of this and the circumstances of the case the usual year's extension of disqualification would not be imposed. said the Magistrate. Hampton), that between October 25 and November 8, she stole a purse and contents worth 95.75 belonging to Helen Elizabeth Davis-Goll The accused pleaded not guilty.
