MAGISTERATE'S COURT Woman On Probation For Three Years For Ill-Treating Child

“While this may be a serious charge, you have had one of the most distressing lives that I have yet had to consider,” Mr K. H. J. Headifen, t S.M., said in the Magistrate’s Court yesterday when a woman' charged with ill-treat-ing her child appeared for sentence. The woman, whose name was suppressed (Mr N. H. Buchanan), pleaded guilty last week to a charge of ill-treat-ing a boy aged four years nine months between November 1, 1966, and August 30, 1968. She was placed on probation for three years on the condition that she undertake medical or psychiatric treatment as directed, and that the child should not be returned to her without the prior consent of the Court. The Magistrate said it was remarkable that the defendant had achieved the degree of sanity that she had. She had had a lifetime of trouble —serious trouble—and her offence was more social than criminal, but it had to be dealt with under the Criminal Law. He said to publish her name when it was a social or medical case would be quite unjust and she deserved some consideration. The defendant had obviously been on the receiving end of all misfortunes that could afflict a person, said Mr Buchanan. She never knew her father, she was raped by an uncle, her mother died, she found it hard to get work, and she had two illegitimate children. The defendant had little control over her impulses and the person on whom she vented her feelings was the weakest and most defenceless of her children. An application would be made by the Child Welfare Division to keep the child, and this application would not be opposed.

SIX MONTHS GAOL Charged with indecently assaulting his 16-year-old daughter, a man whose name was suppressed, was sentenced to six months imprisonment, to be followed by a year’s probation. He had previously pleaded ‘guilty to the charge and was appearing for sentence.

For the defendant Mr A. P. C. Tipping said the offence, which occurred between May 1 and August 30, was most unpleasant and was a bitterly regretted incident in the defendant's hitherto blameless life.
