Application By Doctor (N.Z. Pre.. Awoctation) WELLINGTON, Nov. 4. In a reserved judgment delivered in the Supreme Court, Wellington, Mr Justice Haslam allowed a motion by the Attorney-General, as respondent, to strike out an application by Erich Gelringer, of Wellington, medical practitioner, seeking leave to proceed against the respondent for abatement of an alleged nuisance created by conditions at Porirua Hospital.
His Honour decided that the general scheme of part II of the Health Act, 1956, precludes an application by a private individual with no personal grievance to initiate proceedings under section 33 of the act.
He made an order striking out Dr Geiringert application and allowed $6O costs to the Crown.
