MAGISTRATE'S COURT Man Admits False Pretences And Attempted Burglary

David Andrew Pope, aged 24, an unemployed labourer, was remanded in custody to May 22 for sentence by Mr P. L. Molineaux, S.M.. in the Magistrate’s Court yesterday. Pope pleaded guilty to two charges of presenting two forged cheques valued at $lO each to Hoon Hay Services, Ltd, and O. M. Williams and Sons, Ltd, Kaiapoi, one of false pretences involving a valueless cheque for $lO presented to the Southway Service Station, Ltd, at Templeton, and one of attempted burglary of the premises of Self Help Co-op., Ltd, 93 Victoria Street, Rangiora. Mr R. F. B. Perry appeared for the accused.

Detective Sergeant N. J. Stokes said Pope admitted the offences when interviewed by the police. He had attempted to force a door in the shop at Rangiora and had smashed a window, but failed to gain entry. He said that the two forged cheques had been given to him by an associate who had also given him a blank cheque form which be had filled out. Restitution amounted to $3O. CHARGES ADMITTED Clarence Stephen Gilmore, aged 17, an apprentice clicker, charged with assaulting Edward M. Huria on February 25 and with fighting in a public place on February 24. was fined $lO on each charge. He pleaded guilty to both charges. Detective Sergeant Stokes said Gilmore attended a party in Uxbridge Street on February 24. On leaving about 11.30 p.m. he became involved in a fight on the footpath. Next day he saw the complainant Huria outside a hamburger bar in Harewood Road and without warning struck him on the mouth. FINED $l5O Joseph Okeroa Moeau. aged 19. a soldier, was fined a total of $l5O and placed on probation for a year and a half when he anpeared for sentence on charges of stealing $2« in rnonev and unlawfully taking a car valued at $7OO. The offences occurred at Burnham on May 3 and 5 respectively. Moeau was disqualified from driving for a year.

REMANDED Brian John Turner, aged 17. a workman, was remanded for a medical check and an X-ray until May 17 with a view to sentencing him to periodic detention when he appeared for sentence on a charge of breaking and entering a shed at 8 England Street on April 27. The Magistrate said that the defendant had a considerable record for such a young person and had only recently been placed on probation. ATTEMPTED BURGLARY Winston John Frame, aged 20. a woolclasser. was remanded on bail until May 20 for a probation officer’s report and sentence after he was convicted of attempting to break and enter the New Brighton Hotel on April 16. Frame <Mr M. J. Glue) pleaded not guilty. In evidence, Frame said that the statement produced by the prosecution and signed by himself, in which he admitted knowing that a companion intended to break and enter the hotel, contained statements that he did not say. He said he had not read the statement through entirely after it had been typed. Frame "said he went to the hotel after hours to obtain liquor. STOLE FROM FRIEND Gary Raymond Markwick, aged 29. unemployed. had stolen a record player, four long-playing records and clothing to a total value of $456.41 after he had been invited to the complainant’s home in Victoria Street on the evening of May 14. said Detective Sergeant Stokes. Markwick pleaded guilty to a charge of theft on May 15. Detective Sergeant Stokes said the property had been recovered and the defendant had been Interviewed the following day after he had been seen in a hotel. Markwick was remanded in custody until May 22 for a probation officer’s report and sentence. DAMAGED TELEPHONE A man who pulled the cord out of a telephone because his wife was "always talking to someone who wanted her to take out a separation order” was discharged under Section 42 of the Criminal Justice Act and ordered to pay restitution of $1.50 and Court costs of $5 on a charge of wilful damage. The man, whose name was suppressed, pleaded guilty to the charge. The Magistrate said the defendant appeared to have been involved in domestic troubles, he was under considerable strain, and had a history of mental disorder.

STRUCK PROPRIETOR Robert John Allen, aged 21. a stable hand, was remanded on bail until May 22 when he

was convicted of assaulting Harry Nichol! on February 24. Allen, who pleaded guilty, was represented by Mr M. G. L. Loughnan. Detective Sergeant Stokes said the police were called to the Templeton Hotel about 8.40 p.m. The defendant had struck the proprietor from over the bar after he had been asked to leave the bar and had returned. Allen had objected to the way the proprietor had been talking to him in front of the other patrons, he said. PROBATION AND FINE A man who appeared for sentence on a charge of obscene exposure on April 19 at Belfast was placed on probation for a year and fined $5O. He was Grahame Edward Louder, aged 27, a company representative. Louder was also ordered to pay a fine of $5O and take psychiatric treatment as directed. An application by counsel (Mr A. Hearn) for suppression of name was refused.

MISCELLANEOUS CHARGES On miscellaneous charges brought by the police, fines were imposed as follows with costs of $5 on each charge: Took beer into Burnham Camp: Neville Charles Tucker, costs only. Owned dog which injured cyclist: Violet Emma Mora, $6. Minor found in bar of hotel: Patricia Kay Boyle, $B. Supplied false name: Colin John McDonald, $lO (no driver’s licence, $l5 and prohibited from obtaining a licence for three months).

Passed at intersection: Grant Douglas Craig. $lO. Failed to give way at give way sign: Arthur William Ericson. $l4.

"SUICIDAL” "Suicidal,” commented the Magistrate when Traffic Officer J. P. Bowcock, of the Transport Department, said he checked two racing cyclists riding at 33 miles an hour 3ft behind a large truck and trailer unit in Blenheim Road about 8 p.m. on February 21.

The two cyclists, Graham David Floyd, aged 19, a mechanic, and Ryk Robertus Van Egdom, aged 20, a mechanic. who did not appear, were each fined SlO and were ordered to pay Court costs on a charge of carelessly riding a cycle. Traffic Officer Bowcock said the two cyclists were pedalling furiously with their heads down in the slipstream of the vehicle.

OTHER TRAFFIC CHARGES On other traffic charges brought by the Transport Department fines were imposed as follows with costs of 85 on each chargerExceeded 30 mites an hour: Eva Mary Aitken. 824; John Henry Dixon, 814; Kenneth Gill, 822: Mathvs Jan Lautenbach, 814: George Albert Swankey, 812. Insufficient lights: Stephen Robert Etherington, 86 (no warrant of fitness, 82. failed to stop at compulsory stop sign, $10). No red rear light: Winston Samuel Hume, 88 (noisy motor vehicle, 810, failed to produce driver’s licence, $8). Failed to keep left: John Galvin Donnelly, costs. Failed to stop for school patrol: Robert Bruce Moore, $l4, and licence cancelled for three months. Exceeded 55 miles an hour: Brian George Blackwell. $l5; lan Wilkie Penney. $10: Donald Henry Thomas Smith. $lO. No red rear reflectors: Arthur Ross Bussell, costs.
