Case On Name Tussaud
Madame Tussaud’s, Ltd, the London waxworks firm, has secured settlement by an order of the Chancery Court in. London against Josephine Tussaud and Company, Josephine Tussaud, Ltd, and Keith Leopold Holland Gems over the use of the name Tussaud. Madame Tussaud’s alleged that the firm, company and Gems supplied figures to Waxworks museums in North America intending that their trade name would suggest that the figures had come from Madame Tussaud’s. It alleged that Gems entered partnership with Josephine Tussaud for the purpose of using her name. The terms of the settlement were that the United Kingdom Josephine Tussaud firm should not conduct any further business, that the United Kingdom Josephine Tussaud company stop using “Tussaud” as part of its name or any trade mark, and that Gems should resign his directorships of every company in the United States and Canada using the Tussaud name and not seek re-election, even if those companies changed their names.
On this settlement Madame Tussaud's then waived any claim to damages.
