African Sues Minister

An African prisoner under sentence of death for murder made South African legal history when he brought a civil action against the Minister of Justice and the At-torney-General to have his conviction quashed. But the action was dismissed. Paulos Makoena was sentenced to death a year ago for the murder of an African woman. His appeal against conviction and sentence was dismissed in November. The civil action alleged that perjured evidence was given against him at his trial and that he was couvicted on evidence from cell-mates that he had confessed to the murder to them while in prison. The Justice Minister and Attorney-General applied for the action to be dismissed on the ground that the courts had no power in a civil action to annul a criminal conviction.
