Magistrate's Court Four Years’ Imprisonment On Fifteen Burglary Charges

"This is one of the worst cases of its type that the court has had to deal with for some considerable time,” Mr E. A. Lee SJf. said in the Magistrate’s Court yesterday when he sent a man to gaol for four years on 15 charges of burglary. Colin John Hancock, a presser, aged 29, was sentenced to a year’s imprisonment for burglary of Dick’s Diner on August 27, last year. He was sentenced to one year for burglary of the Corner Fruit Supply and one year for burglary of the Darfield Fruit Supply. These terms are cumulative. On the other twelve charges of burglary he was sentenced to one year’s imprisonment on each charge. These terms are concurrent but the whole term is cumulative on the other three.

Mr G. R. Lascelles, for Hancock, said he was still a relatively young man. He had not started offending until he was 24, when be was first brought before the court on a criminal charge. At this time he was with a more experienced offender. He was, Mr Lascelles, said what one might call “a latedeveloping offender.” Hancock had good intellectual ability and many of his employers had spoken very highly of him. One said he was the best employee the firm had ever had.

"It is a tragedy that a person of your ability, intelligence, physique, and ability to satisfy employers and earn high wages has to take this course,” the Magistrate said. Hancock was remanded for one week on 13 other charges of burglary to which he had pleaded not guilty.

FINED £5O George Raymond Longshaw, aged 23, a workman, was fined £5O, when he appeared for sentence on a charge of receiving a television set from Darryl Ulingsworth knowing at the time that it had been stolen.

Mr P. L. Tempero, who represented Longshaw, said the defendant could not resist getting something for nothing. He had been offered the television set by a casual acquaintance. He could not be regarded as a troublemaker and he had not appeared before the court since 1962.

IDLE AND DISORDERLY Carol Agnes Alexi Kelly, aged 24. an • unemployed waitress, was convicted and released on probation for one year when she appeared for sentence on a charge of being Idle and disorderly at Lyttelton, tn that the had i insufficient means of support, on January 31. The Magistrate said she would live and work where the probation officer directed. NINE MONTHS* GAOL John Albert Donnelly Gearschawski. aged 33, a labourer, was sentenced to nine months’ imprisonment when he appeared for sentence on three charges of unlawfully taking motor one charge of driving while disqualified and a charge of theft of a power cycle valued at 140.

THEFT Leon Errol McDonald, aged 21, a machine operator, was fined £l5 when he appeared for sentence on a charge of theft of a transistor radio valued at £2O. DISQUALIFIED James Harold. Wells-Green, aged 20, a labourer, pleaded guilty and was fined £lB and disqualified for 18 months on two charges of careless use of a motor-vehicle and falling to stop after. an accident on Colombo street on December 31. On the charge of careless use he was fined £8 and disqualified for three months, and on the charge of failing to stop, £lO and disqualified for six months.

Sergeant V. F. H. Townshend said Wells-Green had driven off from the lights at Hereford street and when half way across the road he stopped and reversed his car at nigh speed. He backed Into a car behind him, engaged first gear, and drove off Into Hereford street without stopping. When interviewed by the police, Wells-Green admitted the offences and said he had got

half way across Hereford street when he noticed a scuffle on the footpath. He reversed his car to have a better view of the scuffle. When he hit the car behind Mm he panicked and drove off thinking he had a good chance of getting away without being caught. DANGEROUS DRIVING

Kelvin Rana Russell, aged 17, a factory hand, was fined £2O and disqualified from driving for two years when he pleaded guilty to a charge of driving in a manner which might have been dangerous on the corner of Manchester, High and Tuam streets on November 13.

NOT REGARDED LIGHTLY “1 do not regard this charge lightly,’’ the Magistrate said, convicting Brian Ltoyd Jones, a storeman, aged 28 (Mr D. H. Stringer), of obstructing Detective Sergeant A. B. Dalzell in the execution of his duty, and assaulting him on December 3. Dalzell and three others had broken Into a house in Antigua street, occupied by the defendant, in execution of a search warrant, after the defendant had failed to respond to shouts through a hole in his bedroom window. The defendant claimed to have been in a deep sleep after drinking heavily ths previous night. When he prised a board off the ceHtag with a jemmy-bar, the defendant had grabbed him by the shoulders, Dalzell said. The defendant said in evidence that he had been perturbed by the damage done to his flat and had reached for the bar. Jones was fined £l5 for obstructing a policeman and £5 for assault. FINED FOR ASSAULT “One can sympathise with the defendant In the loss of his wife and with his desire to take out his children.” the Magistrate said, convicting Patrick William Hammond, a freezing worker, aged 42 (Mr L. M. O'Reilly), of assaulting M. E. Kitto at Tuahlwl on December 18. But the remarks which led to the assault ware made by the eornsJatzumt'a wife, set the

complainant, the Magistrate said, and so the assault was not justified.

The incident occurred when Hammond went to pick up one of his children, who was staying with Kitto, to take him out tor the week-end. An argument had arisen, in which the complainant’s wife had referred to a previous charge, on which the defendant had been acquitted, and said he was not fit to be a father to his children. The defendant had gone to the kitchen, and when the complainant had followed, had struck him on the face, breaking his dentures. Hammond was fined £5 and ordered to pay £2 7s 6d in restitution. "UTMOST RESTRAINT” The authorities at the Queen Mary Hospital, Hanmer, had acted with the utmost restraint and tolerance, and the defendant had abused their leniency, the Magistrate said, convicting John Peter Hogan, a worker, aged 60 (Mr A. B. Harman), of being unlawfully on enclosed premises on January 25. Hogan had been dismissed from hie position as a gardener at the hospital two days before and had not vacated his room in the male staff quarters. He had offered a number of inconsistent excuses, the Magistrate said; he was drying his clothing, he was collecting money owed to him, he had a back injury. Counsel for Hogan said that a fieroon might be expected to eave a hotel room within an hour or so, but the defendant had been staying in the room for some months. Hogan had gone around making trouble after his dismissal and was entitled to stay for no time at all, the Magistrate said. Hogan was ordered to come up for sentence within six months if called upon. FAILED TO GIVE WAY Robin Alan Brown, a hospital ordeMy, aged 28 (Mr P. D. Hinchcllff), was convicted of falling to give way to a vehicle on his right at the intersection of Madras and Tuam streets on December 7. The Magistrate said he would take into account that the defendant was almost dear of the intersection when the accident occurred, and fined him £7 10s. EXCEEDED 30 m.p.h.
