Appeal Disallowed

The appeal by T. J. Tabak against his recent suspension has been ruled out of order and the suspension still stands.
This was stated yesterday by the secretary of the Amateur Cycling Association (Mr V. R. Ross). He confirmed that an appeal had been received and had been discussed by members of the association’s council executive. “The appeal is out of order on two counts,” said Mr Ross. “No Higher Body” “First, there is no appeal at all against council decisions. Our rules state that once an individual or club has lodged an appeal against a decision to a higher body, the decision appealed against shall become null and void until the appeal is heard. “But there is no higher body than the council.” Mr Ross said that the second ground on which Tabak’s appeal was out of order was that the fee of 10s had not accompanied the appeal. Unable to Compete This decision now means that Tabak will not be able to compete in the Canterbury chamoionships. which begin at English Park on Friday night. It also means that unless a special meeting of the eoun-l
cil is requisitioned almost immediately, Tabak will not be able to compete in the New Zealand championships and defend his 4000-metre pursuit title.
The next council meeting on February 28, is after the closing date for entries at the championships and suspended riders cannot be entered.
Championship entries close on February 26, and as a special meeting of the council requires 14 days’ notice, any action to convene one would be needed in the next few days.
