SUBDIVIDERS’ RIGHTS

Land In Lieu Of Cash The Town and Country Planning Appeal Board on Wednesday affirmed the right of subdividers to offer land in lieu of cash payments as reserve contributions to local bodies. The board, comprising Mr J. W. Kelly, S.M, chairman, Mr R. R. Beaumont and Mr W. F. McArthur, had before it an appeal by the joint owners of a piece of land at 117 Waimairi road, Andrew Preston Todd and Elizabeth Barbara Todd. Mr and Mrs Todd appealed to the board after the Waimairi County Council had ordered payment of £149 8s 6d as reserve contribution for the subdivision of land into two sections. They claimed that the council had not allowed them to set aside a piece of land in lieu of the reserve contribution. The board authorised the appellants to pay the reserve contribution to the council whenever either section of the subdivision was sold.
