MAGISTRATE’S COURT Motorists Warned Of Duty To Stop At Rail Crossings

Compulsory stop signs erected at railway crossings had been placed there to protect motorists, Mr K. H. J. Headifen S.M., said in the Magistrate’s Court yesterday. If people did not stop they could place the train driver in a difficult situation. If a person were killed in a crossing accident in which a car had failed to stop at a stop sign that could weigh heavily on the train driver even though he would not be to blame.

The Magistrate said, when dealing with a number of charges of failure to stop at a compulsory stop at railway crossings, that he would impose a £5 fine which he considered was a warning. Traffic Officer J. A charge of unlawfully supplying liquor to Peter Douglas Cocks and another on August 28, against Maurice Frederick Neiman, aged 42, a hotel manager, was dismissed. Neiman pleaded not guilty. The Magistrate said that the prosecution had not challenged Cocks’s evidence when he said that he had not purchased any beer, and that a guest of the hotel, Calvin Smith, had bought the liquor. “The charge must be clearly and fairly shown to the defendant so he can prepare a defence. The words in the charge ’and another’ don’t give him this chance,” said the Magistrate, Mr K. N. Hampton appeared for Neiman. BURGLARY Robert Wayne Parata, aged 17, a workman, pleaded guilty to a charge of breaking and entering on November 27, the premises of Home Bakery Ltd., 753 Colombo street. He was convicted and remanded in custody till December 5 for a probation officer’s report and sentence. Senior-Sergeant G. M. Cleary said the premises had been entered by forcing the hard board covering of a window, and £4O was taken. IDLE AND DISORDERLY Two unemployed factory workers, Leslie Arvid Dillon, aged 50, and Anthony McHerron, aged 50, appeared on charges of being idle and disorderly persons in that they had Insufficient means of support. Dillon pleaded guilty and was convicted and remanded till December 8 for a probation officer’s report and sentence. Senior-Sergeant Cleary said Dillon had admitted sleeping out for several nights and had 10s 2d in his pocket when arrested. McHerron pleaded not guilty and the hearing was adjourned to today. He told the Magistrate he had been trying to get a job. CONVICTED AND REMANDED John William Morgan, aged 36 was convicted and remanded on bail until December 6 for a probation officer’s report and sentence after he had pleaded guilty to charges of driving while disqualified from New Brighton road to Cashel street and supplying false information on November 15. Traffic-Sergeant H. J. McMorran said that about 8.25 p.m. on November 15 Morgan had driven a motor vehicle on New Brighton road. Fleete street, Mcßratneys road, Locksley avenue, Gloucester street, Linwood avenue and Cakhel street while disqualified. Morgan had been recognised by a traffic officer who suspected him of being a disqualified driver. Another officer was called who recognised Morgan.

Sergeant McMorran said that when stopped Morgan had given his name as Russell Hamilton. However he later admitted his name was John William Morgan.

REMANDED Patrick Frederick Mullally. aged 45, a truck driver (Mr S. G. Erber )was remanded in custody for a Lower Court hearing on December 7 when he appeared on a charge that on October 10 with intent he had caused grevious bodily harm to Kevin James Robert Mullally.

One charge of attempted abortion and three charges of unlawfully using an instrument with Intent to procure a miscarriage against Florence Kathleen Wilson, aged 41, a shopkeeper (Mr G. R. Lascelles) were adjourned to December 6 after 11 of the 18 prosecution witnesses had been heard.

The charges covered various periods between August 1 and October 21. Wilson was remanded on bail.
