MAGISTRATE’S COURT Two Men Gaoled On Charges Of Dishonesty

Two men were imprisoned for two years and a half when they appeared for sentence before Mr H. J. Evans, S.M., in the Magistrate’s Court yesterday on charges of theft, obtaining credit by fraud and committed in Dunedin and Oamaru during June and July. They were Barry James Richards, aged 27, a carpenter, and Thomas Henry Pink, aged 35, a workman.

Richards was sentenced to two years’ imprisonment for his part in the Dunedin burglary on July 5, and six months’ imprisonment on charges of obtaining credit by fraud at Oamaru on July 5 and Dunedin on June 29. The Magistrate ordered that the six-month terms of imprisonment should be served concurrently with each other and cumulative on the two years imposed for burglary.

Richards was remanded to July 28 on a charge of using obscene language at Christchurch on July 6, to which he pleaded not guilty.

Pink was sentenced to two years’ imprisonment on each of the charges of burglary at Dunedin on July 5, and theft at Dunedin on June 17. He was sentenced to six months’ imprisonment on charges of obtaining credit by fraud at Oamaru on July 5 and attempted false pretences at Christchurch on July 5. The Magistrate ordered that each of the terms of six months’ imprisonment be served concurrently with each other and that the two terms of two years’ imprisonment also be served concurrently with each other. He further ordered that sentences for burglary and theft be cumulative with those imposed for obtaining credit by fraud and attempted false pretences. PROBATION AND FINES Yan Graeme Steel, aged 17, a packer, was admitted to probation for two years and was fined a total of £3O when he appeared for sentence on

charges of unlawfully taking motor-cycles valued at £4O and £65, the property of Trevor Phillip Pearce and Malcolm James Dobson, and unlawfully getting on a motorcycle, valued at £l5O, the property of Bryan John Down. Steel was ordered to live and work where directed and not to associate with anyone disapproved of by the probation officer.

Mr W. A. Wilson, who appeared for Steel, said that this was the accused’s first appearance in the Magistrate’s Court The offences had been committed a short time after his seventeenth birthday. Mr Wilson said Steel was adamant that he did not ride the motor-cycles but was merely a pillion passenger on them. Steel was a disqualified driver at the time. He had some reason to believe that the rider of the first motorcycle had authority to have the machine. Steel gained nothing from the offences and it was his accomplices who were the ring leaders. “You are only 17, but you have been in a lot of trouble much of which relates to motor-vehicles,” the Magistrate said. “You have been placed on probation for unlawfully taking a car and later you were sent to a periodic detention centre for unlawfully taking a truck and a motor-cycle. This is your last chance.” FINED £l5 Leo James Wilson, aged 32, a salesman, pleaded guilty to a charge of attempting to leave New Zealand without complying with the conditions of a maintenance order. He was convicted and fined £l5, ordered to pay £54 7s in arrears, and to pay a month’s maintenance in advance. An order was also made for Wilson to make arrangements for payment of future maintenance. The Magistrate gave Wilson permission to leave for Australia last night to take up a position in Brisbane. Mr A. Hearn appeared for the defendant FINED £5 Thomas Jumbo Wilson, aged 20, unemployed, was fined £5 on a charge of breach of probation by failing to report and was convicted and discharged on a charge of stealing a container of orange drink, valued at 6d, from a vending machine at Gisborne. He pleaded guilty to both charges. STOLE RAZOS David John Green, aged 20, a truck driver, was fined CIS when he pleaded guilty to a charge of theft of an electric razor, valued at £9 10s, the property of Douglas Archie Friar, on July 17.

Sergeant G. Mulcare said that the accused was living at the same house as Friar at the time of the offence. PROBATION AND FINE Gary Vincent Shields, aged 18, a stone worker (Mr A. P. C. Tipping), was placed on probation for 12 months and fined £2O when he appeared for sentence on a charge of attempted unlawful sexual intercourse at Dunedin on June 18. MISCELLANEOUS OFFENCES Failed to notify deputy-regis-trar of sale of motor-car. Henry Lennin Ross, £3. Minor drinking in a public place: Brian Alan Borck, £5; Andrew Mackston Dobson, £4. Consumed liquor on licensed premises after hours: Alfred Leonard Sheedy, £3. Found in lounge bar after hours: Joan Audrey Sheedy, Court costs £1 10s. Sold firearm without a permit: Reginald Mervyn Hollands, £3. Procured firearm without a permit: Kenneth William Button, £3 10s. FINED 525 FOR ASSAULTS Barrie Keith Henry Seiwood, aged 18, an assembler, was fined a total of £25 on charges of assaulting Murray Maitland Everett and Warren Gregory Rochford, both aged 15, on May 26. He was appearing for sentence.

Mr G. R. Lascelles, whe appeared tor Seiwood, said the offences were not serious ones, and the boys had come to no serious harm. Seiwood was a good worker. “You have had no previous convictions for violence, but there was not the slightest justification for these offences,” said the Magistrate. “You are making an effort to settle down after undergoing Borstal training but you must learn to keep your hands to yourself.” Seiwood was ordered to pay witnesses' expenses of £2. FINED £3O Edward Cedric Shave, aged 43, unemployed, was fined a total of £3O on two charges of obtaining credit by fraud and was convicted and discharged on a charge of breach of probation by failing to report. He was appearing for sentence. Shave was not represented by counsel. The Magistrate said Shave’s problem was drink. Shave was ordered to make restitution of £39 15s. BARMAN FINED Eric Robert Booker, aged 42, a barman (Mr P. G. S. Penllngton) changed a plea of not guilty to one of guilty and was fined £5 on two each of two charges of selling liquor at a time when not authorised, and £l9 on a charge of supplying a minor with liquor. MANAGER CONVICTED Walter Edward Jehu Davie, a hotel manager, aged 67 (Mr P. G. S. Penlington), was fined £5 on two charges of selling liquor at a time when not authorised and £lO en a charge of supplying a minor with liquor. CHARGE DISMISSED

A charge against Gordon Charles Rew, aged 42, a hotel manager {Mr R. G. Blunt), of allowing the consumption of liquor on licensed premises after hours, was dismissed.
