Salesman Wins Claim

PALMERSTON NORTH, May 6. Glaxo Laboratories (N.Z.) Ltd., of Palmerston North, was not justified in summarily dismissing a former sales representative, Graham Munro, Mr D. G. Sinclair, S.M., found in a reserved judgment this week on a case heard on March 8.
The plaintiff Munro had asserted that his summary dismissal, after which he had been paid one month’s salary, had been unreasonable, and he claimed three months’ salary. This has been granted by the Court at £9B, being £258 for three months, less eight weeks’ earnings at £2O a week in other employment found by the plaintiff a month after his dismissal.
The second part of the plaintiff’s claim represented
the balance of his pension scheme contributions of £507 15s. The defendant company refunded £377 15s, but retained £l3O for part of money advanced to the plaintiff to cover expenses of his transfer to Dunedin. The Court ruled that the £4BO was advanced to the plaintiff to cover expenses by way of gift, and the £139 was therefore wrongfully retained by the defendant company. Accordingly, judgment was for the plaintiff for £228 5s Bd.
