Incorrect Report

WELLINGTON, Dec. 28.
In a Press Association message from Wellington yesterday it was incorrectly reported that an injunction had been issued in the Magistrate’s Court at Lower Hutt preventing the Marcel Academy of Elegance from using the words “Academy of Elegance.” No injunction has actually been issued.
The Magistrate’s decision is under appeal, and no injunction is to issue unless the appeal fails. The parties in the case. Academy of Elegance (Wellington) Ltd., the plaintiff, and K. Earle, trading as the Marcel Academy of Elegance, the defendant, have agreed that the injunction be suspended pending the appeal.
It is therefore not correct to say the defendant is, as yet, prevented from using the words “Academy of Elegance” as part of her trade name. Her right to continue to do so depends upon the result of further litigation.
