Court Holds Traffic Officer Responsible For Accident
(N.Z. Press Association) WELLINGTON, Dec. 18. An accident in Wellington on April 10, IM4, when a traffic ' officer’s motor-cycle struck and seriously injured a man on a pedestrian crossing while the traffic officer was escorting a medical practitioner on an emergency call, had a sequel in the Supreme Court. Mr Justice McGregor awarded £3400 damages against the Wellington City Council, holding the traffic officer bad been negligent S“ G«W Hne. aged M a civil servant claimed £7500 damages. He
was awarded £3OOO general and £4OO special damages. His Honour said the convoy approached a . stationary vehicle near the centre of the road. The doctor was able to pass to the left side of thia vehicle while the traffic officer overtook it on its other ride. This required him to ride on the tram lines where his motorcycle got out of control. “The traffic officer had full knowledge of the locality and of the inherent danger of the unused tram lines, and it seems to me that he should have reduced speed even at the risk of losing the doctor’s motor-vehicle when be had to pan round the stationary vehicle,** said his Honour.
