Careless Driving Causing Death

A jury in the Supreme Court, Auckland, today found Colin Joseph Renall, aged 30, a farmer, guilty of careless driving causing death.
Renall was found not guilty on the alternative charge of dangerous driving causing the death of Norton Neal Galloway. He had pleaded not guilty to both charges which arose from a car accident in the Woodhill area of the Auck-land-Helensville highway on February 14, in which three persons were killed. The hearing was before Mr Justice Hardie Boys. Mr D. S. Beattie, Q.C., and Mr R. I. Barker represented Renall. Mr G. D. Speight appeared for the Crown. The Crown alleged that Renall overtook a car on a curve and collided with Galloway’s car which was travelling in the opposite direction. The jury must first be satisfied without reasonable doubt
that Renall was overtaking as Mrs Gabriel Hildreth, driver of one of the cars, claimed, said His Honour in his sum-ming-up. Both charges spoke of negligence, his Honour said, except one was more serious. If by the evidence the members of the jury were without doubt that Renall fell short of what he was expected to do, thus causing death, then they would have to decide how he fell short—whether it was dangerous or careless. Renall was remanded for sentence.
