Court Holds Evidence Of Police Inadmissible
(N.Z. Press Association) PALMERSTON N, July 23. A charge of assault on her four-year-old child brought against a young woman, was dismissed ’ by Mr Justice Tompkins today after legal argument on an alleged admission by the accused to a policeman. The accused was Koi Matariki Lynn. Mr J. A. Ongley appeared for the Crown, and Mr C. G. Hubbard for Lynn. Detective-Sergeant R. W. Bamber, of Levin, had just started giving his evidence when Mr Hubbard said he wished to make objection to evidence about to be given. The witness at that stage
was referring to a conversation he had had with Lynn in a neighbour’s home after “certain information” had been given him. His Honour found that the evidence, while not specifically excluded by the judges’ rules, was contrary to the spirit of the rules, and should be held inadmissable. He recalled the jury and explained that the Court had found it proper in the interests of justice to exclude the evidence. The Crown, he said, had no further evidence to offer on the allegation and there had been no real evidence up to date to support the charge He dismissed the charge and discharged Lynn.
