Speight, for the Crown, submitted the verdict on malicious prosecution could not be valid according to the jury’s submissions on various points of fact. His Honour said Wood had entirely failed to discharge the burden of proving an absence of reasonable and probable cause for his prosecution by the police. He awarded Wood costs and special damages, as agreed between the parties.
