Magistrate’s Court Disqualified Driver Fined And Permit Cancelled
Charged with driving while disqualified on the Main North road at Kaiapoi and careless use of a vehicle on March 21, Alexandre Bracey, aged 25 (Mr P. G. S. Penlington), pleaded guilty before Mr E. S. J. Crutchley, S.M., in the Magistrate’s Court yesterday. On the charge of driving while disqualified. Bracey was convicted and fined £3O. and his period of disqualification was extended for one year. A permit allowing him to drive during his employment was cancelled. On the other charge, he was convicted and fined £lO. The Magistrate said that Bracey could well have gone to prison. BORSTAL TRAINING “You apparently cannot keep out of trouble on your own,” said the Magistrate when he sentenced Rex lan Donaldson, aged 18 (Mr G. R. Lascelles), to Borstal training on charges of unlawful taking of a car on March 6, theft of £lO on March 7, and attempted unlawful taking of a car on March 7. Donaldson was appearing for sentence. BURGLARS SENTENCED Lawrence Pritchard, aged 18, a workman, and Trevor Michael Pike, aged 18, a workman, appeared for sentence on six joint charges of burglary and one of attempted burglary. Pike was sentenced to Borstal training and Pritchard was admitted to probation for two years. Pritchard was ordered to pay £2O towards the cost of prosecution and to make restitution of £l5 9s Id.
Mr N. H. Buchanan appeared for both accused. Making submissions for Pike, Mr Buchanan said that he had a hopeless attitude towards life, and a bad relationship with his father, who was a heavy drinker. Pike was on probation when the offences were committed.
Pritchard had not appeared before the Magistrate’s Court previously, Mr Buchanan said. The Magistrate said he was in two minds whether to send Pritchard to Borstal, but the probation officer thought he was worth a chance.
Pritchard was disqualified from driving for two years. ASSAULT
Bruce Alexander Patterson, aged 17, unemployed, was fined £lO on a charge of assaulting Allister Gilmore Stewart in Cathedral square on March 27. Patterson pleaded guilty. David Alexander Wilson, aged 20, a plant operator, who pleaded guilty to assaulting Stewart, was convicted and fined £5. ASSAULTED CONSTABLE
Allen James Thompson, aged 18, a workman, was fined £2O on a charge of assaulting Constable W. P. Creasey in the execution of his duty, and £lO on a charge of using obscene language in Elgin street, and was convicted and discharged and ordered to make restitution on a charge of wilful damage of a tie, the property of the Police Department. The offences were committed on March 11, and the accused was appearing for sentence.
Mr R. H. Stewart, for Thompson, said that he had a formidable list of convictions, but had a good work record.
The Magistrate said that if Thompson offended again he would go to Borstal. TWO YEARS’ GAOL Edward George Hawker, aged 34, a loom operator (Mr S. G. Erber), was sentenced to two years’ Imprisonment when he appeared for sentence on a charge of having unlawful sex ual intercourse with a 12-year-old girl living under his care and protection as a member of his family on January 3. He had previously been convicted of the offence. 18 MONTHS’ GAOL A term of 18 months’ imprisonment was imposed on Arthur Don Davies, aged 40, a clerk (Mr C. B. Atkinson), when he appeared for sentence on a charge of obscene exposure on January 7 and four charges of
indecent assault on a boy between September 1 and December 18. He had previously pleaded guilty. INDECENT ASSAULT Kenneth Wright, aged 35, a labourer, was sentenced to four months’ imprisonment on a charge of indecent assault on a giri aged 12. Wright, who was appearing for sentence, was represented by Mr A. K. Archer. YOUTHS FINED Charged with using indecent language, Denis Vincent Lees, aged 17, pleaded guilty and was convicted and fined £5. Charged with fighting, David Barry Mathias, aged 17. pleaded guilty, and was convicted and fined £5. Sergeant V. F. Townshend said that Lees used indecent language after police had visited a house in Kilmore street on March 27. where a noisy party was being held. After Lees w’as arrested two youths began fighting. ASSAULTED WOMAN The accused pushed the com plainant into a bath, turned the cold water on. and held her under until she was soaked, Sergeant Townshend said when Allan Schooner Hona, aged 34, a welder, pleaded guilty to assaulting Kinga Mako on March 27. Hona was convicted and remanded on bail to April 5 for sentence. Sergeant Townshend said that the assault occurred at a party in Burwood road. The accused claimed that Mako had been making a nuisance of herself. FINED FOR ASSAULT John Terrence Docherty, aged 18 (Mr A. B. Harman), was fined £7 when he appeared for sentence on a charge of assaut on January 23. He was ordered to pay witnesses’ expenses of £l. WILFUL DAMAGE Charged with wilful damage of electrical fittings valued at £7 3s 6d, the property of the New Zealand Railways Department, at Springfield on January 25, procuring a firearm without a permit at Springfield on January 25, and discharging a firearm to the danger of the public at Springfield on January 25. David Arthur Ford, aged 18. a locomotive trainee, pleaded guilty. On the charge of wilful damage, he was convicted and fined £6, and was ordered to pay restitution of £3 Ils 9d. On the charge of discharging a firearm he was fined £6, and on the other charge he was fined £3. RECEIVER FINED John WilHam King, aged 18, unemployed (Mr M. J. Glue), was fined £lO on a charge of receiving cigarettes valued at £1 5s from John Graham King on March 12 when he knew that they had been dishonestly obtained. King was appearing for sentence. The Magistrate said he agreed with counsel that it was a somewhat technical offence, but it seemed almost inevitable that King would go back to Borstal unless he changed his attitude. PROBATION John William Whitty, aged 21 (Mr J. W. Dalmer), was admitted to probation for one year and ordered to pay £l5 towards the cost of the prosecution on a charge of unlawful sexual intercourse. FALSE PRETENCES Lawrence Wilfred Ockwell, aged 27, was convicted and
ordered to come up tor sentence within 12 months if called upon on charges of false pretences and a breach of the Hire Purchase Act at Wellington. He was ordered to make restitution of £35. He was not represented bv counsel. The Magistrate said that Ockwell had no previous convictions and had a good work record. His offence had been more foolish than criminal, but It had been carefully planned. UNLAWFULLY IN YARD Charged with being unlawfully in an enclosed yard in Division street on March 28 in circumstances that did not disclose an intention to commit an offence. David Hose, aged 31. a labourer (Mr D. C. McCaskill), pleaded guilty. He was convicted and lined £5. FINED FOR ASSAULT Charged with assaulting Richard Harry Neal In Colombo street on March 27. Brian Vincent McDonald, aged 19 a driver, pleaded guilty. He was convicted and fined £7 10s.
