Traffic Officer R. Phillip said that at 11.25 a.m. on November 26 he saw a car driven by Knox in Moorhouse avenue turn left into Montreal street from the wrong lane. He checked the speed of the car at 36 miles an hour in Montreal street. When turning into South Crescent road the car went on to the wrong side of the road, and passed another vehicle on a slight bend. The warrant of fitness had expired in the same month.

The Magistrate said there were not the usual features of careless driving in the case, as there were no gross breaches of the regulations. What the defendant had done was to take some liberties with the regulations because he believed no-one was exposed to danger.
