Retrial Begins

NEW PLYMOUTH, Feb. 16. The retrial began in the Supreme Court at New Plymouth today of Bruce Wyville Rutherfurd, aged 47. a Stratford medical practitioner, who is pleading not guilty to a charge of unlawfully attempting to procure a miscarriage. Mr Justice Haslam is on the bench. Another charge of manslaughter brought against Rutherfurd in the first trial in October, 1964, has been withdrawn. Rutherfurd was charged that on July 20, 1964, at Stratford he had with intent to procure a miscarriage unlawfully used a uterine sound on the deceased, a woman aged 25. Mr J. P. Quilliam appears as the Crown prosecutor and the accused is represented by Mr J. R. P. Horn, with him Mr C. E. H. Pledger.

There are two women jurors. Evidence was given by four prosecution witnesses today before the court adjourned until tomorrow.
