Magistrate’s Court Man Obtained £157 By Making False Declarations

Charged with making false declarations under the Social Security Act, William Conway, aged 63, a retired workman, pleaded guilty in the Magistrate’s Court yesterday. He was convicted and remanded on bail to December 23 for sentence by Mr K. H. J. Headifen, S.M. Senior-Sergeant G. M. Cleary said that Conway twice made false declarations for unemployment benefits by saying that his wife was not working. Conway received £157 9s 6d to which he was not entitled, but he had arranged to make restitution. ROGUE AND VAGABOND It was the accused’s tenth appearance since August. 1963, on an idle and disorderly, or similar, charge. Senior-Sergeant Cleary said when Thomas Shearer, aged 43, an unemployed workman, pleaded guilty to a charge of being a rogue and a vagabond on December 16 in that he had no lawful means of support and had been convicted of being idle and disorderly. Shearer was convicted and remanded until January 11 for a psychiatric report. Senior-Sergeant Cleary said that when Shearer was questioned in Cathedral square at 11 a.m. on December 16 he said he had been released from prison, where he had been serving a term of imprisonment for being idle and disorderly, on the previous Monday. He had not worked since his release, and did not intend to look for work. ASSAULTED WIFE Bryan Reginald Price, aged 31, a lineman, was fined £lO when he pleaded guilty to a charge of assaulting his wife on December 15. Senior-Sergeant Cleary said that at 6.45 p.m. the police spoke to the accused’s wife, who said that Price had struck her on the face. When interviewed Price admitted the offence, but could give no reason for his action. FINED £l6

Gary Eric Eden, a welder, was 'fined £8 for exceeding 55 miles an hour, £5 for exceeding 40 miles an hour with a pillion passenger, and £3 for exceeding 30 miles an hour without a safety helmet. He was ordered to attend three lectures conducted by the Christchurch City Council. Mr G. R. Lascelles, who appeared for the defendant, entered pleas of guilty. Traffic Officer B. K. McBride said that at 3.15 p.m. on October 17 he checked a motor-cycle ridden by Eden in Russley road between Memorial avenue and Yaldhurst road at speeds of up to 85 miles an hour. Eden said he was in a hurry to get to Ruapuna Park. Neither the driver nor his passenger was wearing safety helmets. Mr Lascelles said that Eden was a very experienced motor-cyclist.

EXCEEDED WEIGHT LIMITS To charges of exceeding his heavy-traffic licence, exceeding the gross weight, and exceeding the axle weight on August 15, Bernard Henry Bankes Scott, a logging contractor (Mr J. H. M. Dawson), pleaded not guilty. He was convicted and fined £5 on the charge of exceeding his heavy-traffic licence, and was ordered to pay costs on the other two charges. The Magistrate said he was satisfied Scott had no intention of exceeding the weight limits. FINED £3 On a charge of supplying incorrect information when

applying for a driver’s licence, Peter Norman Rosewarne was fined £3. He pleaded guilty. Traffic Officer C. S. Hansen said that on October 15 Rosewarne applied for a driver’s licence at the Paparua County Council and was tested. He gave an address in Manuera street. It was found that he was not living there, and he was later located living in Springfield road.

Mr S. G. Erber, for Rosewarne, said the charge should not have been brought. It had been intended to defend it. Rosewarne had quarrelled with his wife and intended to leave his home in Springfield road and live in Manuera street when he applied for the licence. However, they were reconciled.

INDECENT ASSAULT Pleading guilty to a charge of indecently assaulting a

girl aged 13 between November 1 and November 30, Ronald Ethelbert Tibbotts, aged 40, a concrete worker, was convicted and remanded to December 23 for sentence. REMANDED Charged with driving under the influence of drink or drugs in Selwyn street early yesterday and causing the death of Stanley Percival Barnett, a taxi-driver, Stanley Robert Cuthbertson, aged 56, a company manager, was remanded on bail until January 28. Vasil Frecka, aged 41, a painter, who appeared on a bench warrant issued for his arrest when he failed to appear, was remanded on bail to December 21 on a charge of driving in Wilsons road on December 15 under the influence of drink or drugs. Derek Raymond Dixon, aged 26, a male nurse, was remanded on bail to January 28 on a charge of driving in Clarence street on December 15 under the influence of drink or drugs. Ronald Russell Taylor, aged 38, was remanded on bail to December 23 on a charge of receiving goods valued at £l2O on November 5, knowing them to be stolen.
