MAGISTRATE’S COURT Convicted Of Burglary And Thefts

George Thomas Body, aged 21, a farm hand (Mr P. H. T. Alpers) was convicted by Mr E. A. Lee, S.M., in the Magistrate’s Court yesterday of stealing articles valued at £36 12s 6d, the property of Neil Douglas Oliver, at Hororata, on July 3. Body pleaded not guilty to this charge and guilty to charges of stealing goods valued at £25 15s 6d, the property of David Charles Smith, goods valued at £6 10s 3d, the property of Peter Tristan Maxted, and burgling the garage of Douglas William John Henry. All the offences were committed at Hororata. Body was remanded on bail to October 1 for sentence. Sergeant S. W. Byers said Body had previous convictions. CHARGE DISMISSED A charge against Desmond John Millward, aged 18, a factory hand, of stealing a signet ring valued at £5, the property of Wayne Maurice Chappell, was dismissed. Millward, who pleaded not guilty, was represented by Mr L. M. O’Reilly. Millward said he took the ring as security for money oWed to him by Chappell. PROBATION Clair Perriton, aged 19. a waitress, was admitted to probation for one year on charges of stealing articles valued at £7 6s and £l5, the property of Lucy Wilson and Noleen Doris Lees. DISCHARGED A girl, whose name was suppressed, was discharged without conviction under section 42 of the Criminal Justice Act on a charge of stealing 2s 6d. CHARGE WITHDRAWN A charge against Peter Waltho, aged 17, unemployed, of unlawfully taking a car was withdrawn on the application of Sergeant Byers, who said that the accused had been returned to an institution on the West Coast. REMANDED George Sutton, aged 43, a farm worker, was remanded in custody to October 1 on a charge of indecent assault on a boy. TAX BREACHES Leonard Hampton Duffield, a restaurant proprietor, was fined £2 on each of five charges of misapplying tax deductions. He pleaded guilty. Mr N. R. Morgan, who prosecuted. said that the defendant was in business at New Brighton. All the amounts had since been paid. The department was not pressing for a heavy penalty. Mr B. L. Stanley, who appeared for the defendant, said the charges sounded worse than they were. There was no suggestion that the money had been applied for another purpose. SHOP NOT CLOSED Bryce Marshall was fined £3 for failing to close his shop tn Springs road on August 8. He pleaded guilty. FALSE PRETENCES Harry George Newey, aged 56, unemployed, pleaded guilty to obtaining a cameo brooch and money to the value of £2O by false pretences from Watson's Jewellers, Ltd., on July 20, and to obtaining credit for £l7 10s by fraud on July 20 from the Devon Private Hotel. He was convicted and remanded in custody to October 1 for sentence. BURGLARY AND THEFT Harold Maurice James Smither, aged 46. a fitter and turner, appeared on charges of burgling the Theatre Royal between August 19 and 22, and stealing four spanners valued at £4, the property of Alan Terry Ibbotson, on August 20. Smither (Mr M. G. L. Loughnan) had already pleaded not guilty to the charge of burglary, and guilty to the charge of theft. He was convicted and . remanded in custody to October 1 for sentence. Eric Vivian Owen, caretaker of the Theatre Royal, said that on August 23 he found that a workshop at the back of the Theatre Royal had been broken into, and a power drill valued at £2l 5s stolen. The defendant sold him the drill on August 19, said John Locksley Patterson, a secondhand dealer. Previously smlther had sold him spanners, and on both occasions he gave a false name and address. In evidence Smither said he sold the drill for a friend named Jack, without knowing ( it was stolen. guilty to a charge of unlawful sexual intercourse on June 13 with a girl aged 13. SHOPLIFTER FINED "Shoplifting is assuming serious proportions in this city," said the Magistrate in fining Violet Catherine Scullard, aged 40, a shop assistant, £lO. Scullard pleaded guilty to stealing goods valued at 3s lid from ' the Self Help Co-op., Ltd., on September 14. "I am not prepared to whittle away the deterrent of publishing offender’s names by suppressing the name in this case," said the Magistrate. STOLE TWO CYCLES Kristen Joseph Smith, aged 18, a workman, was remanded in custody until October 1 when he pleaded guilty to two charges of stealing cycles. Smith stole a cycle valued at £2O from Geoffrey Wayne Rowe on September 17, said Detec-tive-Sergeant Mitten. He also stole a sports cycle valued at £5 from an unknown person on September 16. IDLE AND DISORDERLY Thomas Shearer, aged 43. unemployed, was convicted and remanded in custody until October 1 after pleading guilty to a charge of being idle and disorderly, in that he had insufficient lawful means of support, on September 23. STOLE OFFAL Charged with stealing edible offal, valued at £2 Ils 6d, the property of Canterbury ByeProducts, Ltd., on September 23, Mervyn Day, aged 35, a freezing worker, was fined £lO. He pleaded guilty. Detective-Sergeant Mitten said a foreman of the firm noticed a box in Day’s car. It contained offal. Day had said it was one of the perquisites of the job and was common practice. He admitted taking the offal, but denied selling it for profit. REMANDED Russel! Ivan Downey, aged 29, a painter, was remanded on bail until October 1 on a charge of false pretences involving £325 on September 2. Patrick William Hammond, aged 40, unemployed, was remanded in custody until October 1 on five charges of false pretences, all on September 10. A man, whose name was suppressed, was remanded on bail until October 8 on a charge of receiving a stolen car from Marty Williams, the property of John Woodward, on August John Henry Burrowes, aged 40, unemployed, was remanded in custody to September 28 on a charge of assaulting a female on July 31. Douglas Barry Borton, aged 18, a labourer, was remanded on bail to October 1 on a charge of driving under the influence of drink or drugs on September 18. Stanley Arthur Dumpleton, aged 46, an engineer, was remanded in custody to appear in the Auckland Magistrate’s Court on October 2 on a charge of assaulting Jean Mary Hewitt with intent to injure her at Auckland on February 27,
