Magistrate’s Court Two-Year Disqualification For “Shocking ” Driving

“These were examples of shocking driving; and the only proper course is to remove him from the road for some considerable time,” Mr K. H. J. Headifen, S.M., said in the Magistrate’s Court yesterday when he convicted Paul Lawrence Talbot, aged 17, a painter and paperhanger (Mr J. F. Burn), on charges of driving at a speed which might have been dangerous on August 20, and in a manner which might have been dangerous on June 24. On the charge of driving in a manner which might have been dangerous, Talbot was | fined £l2, and his licence was i cancelled for one year. On i the other charge, he was fined '£B and his licence was cancelled for one year, the periods of disqualification to be cumulative.

Mr Burn entered pleas of guilty. Traffic Sergeant J. McMorran said that at 8.15 a.m. on June 24 Traffic Officer J. Kinghorn was passed in- Cranford street by a car travelling between 40 and 45 miles an hour. In Sherborne street, the traffic officer’s speed reached 55 miles an hour, but Talbot’s car increased its lead. The defendant’s speed in Bealey avenue and Barbadoes street was about 50 miles an hour. Talbot told the traffic i officer that he was late for work, and when he saw the traffic officer, he thought he would “give it a go.” Traffic Sergeant McMorran said that the circumstances on August 20 were similar, except that Traffic Officer W. Noster checked the speed at 55 miles an hour in Bealey avenue. Talbot’s excuse was that he was late for work, and had not watched his speedo. Mr Burn said that Cranford street, which was common to both offences, was a form of through-way, with give-way signs on most of the side streets. LICENCE CANCELLED

On a charge of careless driving on July 9, Gary Arthur Nash, aged 19, a labourer, was convicted and fined £B, and his licence was cancelled for six months. On charges of not having a driver’s licence and a warrant of fitness, he was fined £4 and £3. He did not appear and no plea was entered. Traffic Officer L. Wilkinson said that at 9.35 p.m. on July 9 the defendant drove a light truck on the Papanui road roundabout at a speed of about 20 miles an hour, the vehicle spilling petrol on to the road. At a slight bend in Horner street, the defendant wrenched the wheel to the left, again spilling petrol. At the intersection of Loftus street, Nash swung wide to the wrong side of Horner street and then hard to the left, going completely on to the incorrect side of the road in Loftus street, again spilling petrol.

Ruther- , ford), pleaded not guilty. He ' was convicted and fined £3. The Magistrate said that it was a case of failure to keep a proper look-out, rather than reckless driving. CHARGE DISMISSED A charge against George Turner Long, aged 72, a . pensioner (Mr M. D. Hodgins), of failing to give way to the right was dismissed. Long pleaded not guilty. The Magistrate said that Long took every precaution necessary, but Ewart Harris Price, driving a truck, had not attempted to avoid a collision. REMANDED George Thomas Body, aged 21, a farmhand, was remandled in custody to September 14 on a charge of breaking and entering at Hororata on I September 5. LICENCE CANCELLED Ross Kenneth Taylor, aged 19, was fined £7, and his licence was cancelled for 12 months, on a charge of riding a motor-cycle at a speed which might have been 'dangerous on July- 4. The suspension of licence is to take effect on September 15. Traffic Officer P. Kilroy said he checked Taylor’s machine at 37 miles an hour in Ferry road, 50 miles an hour on the road tunnel approach, and 52 miles an hour on Port Hills road. There were some children and a girl on a horse on the side of the road.

Taylor, in evidence, admitted exceeding 30 miles an hour, but said he did not consider his speed might have been dangerous. He slowed at the intersections. He had made adjustments to the machine and was testing it. FINED £3

Rubin Howell Court, a research worker, pleaded not guilty to driving in Cashel street on July 3 with insufficient lights and having no driver’s licence. He was fined £2 for having no licence, and £1 on the other charge.
