Supreme Court DRIVER WINS APPEAL
No Cancellation Of Licence Mr Justice Wilson in the Supreme Court yesterday allowed an appeal by Kenneth Maxwell Ward against a magistrate’s cancellation and endorsement of his. driver’s licence. In the Kaikoura Magistrate’s Court Ward, on a charge of giving a false name to a traffic officer, was fined £5 and his driver's licence was cancelled for two years. The magistrate ordered that a three-year endorsement be contained on any new licence he subsequently obtained. Ward appealed against his total sentence, but the appeal against the fine was not proceeded with. Mr I. C. J. Polson appeared for the Crown, and Mr A. Hearn for Ward. Mr Hearn submitted that the magistrate had no jurisdiction to cancel or endorse under the section under which the charge was laid.
■ His Honour found there was no jurisdiction for the cancellation nor for the endorsement, but said the fine of £5 would be reimposed. In different circumstances he would have been inclined to increase the fine.
