NEW TRIAL ORDERED
Assessment Of Damages (N.Z. Press Association) WELLINGTON, June 30. A new trial limited to assessment of damages was ordered by Mr Justice Tompkins in a judgment delivered today in the Supreme Court. He held that an amount of £14,375 general damages to a young motor-cyclist in respect of an accident was one at which—on the evidence—no reasonable jury could arrive. The plaintiff, Kevin John Joseph Gray, aged 19, claimed £19,000 from Edith Jean Deakin, of Clive, married. .
His Honour said the evidence was that Gray could hot carry on as an electrical engineer. “He had a left leg with a partially stiff knee and a discharging sinus, but the leg was reasonably strong and enabled him to walk normally except for 4 slight limp.” . • • His Hondur, after reviewing the jury’s award, said, “I think that the jury must have considered the matter from some wrong point of view and without a proper understanding of their duty, that their award is ‘outside the bounds of reason’ and that it was a verdict at which, on the evidence, no jury could reasonably arrive.”
