MAGISTRATE’S COURT Committed For Trial On Rape Charge
An allegation that she had been raped several times on the night of September 14 was made by a woman when, she gave evidence before Messrs J. R. Smith and W. EL! Small, Justices of the Peace, I In the Magistrate’s Court yes-1 terday. Before the Court was George Millar Tod, aged 35, a mechanic, who was committed to the Supreme Court, for trial on a charge of rape/ Tod. who pleaded not guiltv.' was represented bv Mr A. N. J Milne. No application for bail was made. The complainant said that after a dance she was taken; into the country past the end nf Blenheim road and raped hr Tod and a man called Lex. whose full name she did not know. Albert King, a storeman. said he went in a car with the complainant. Tod, and Lex ( oilins to a country area after ■ a dance and a few drinks. Tod, pulled the woman out of the car, and he heard her calling out. “Leave me alone.” Tod and Collins each had inter-! course with the complainant several times. King said that the woman was terrified. In a statement produced by the police Tod said he did not pull the complainant out • of the car: he just helped her out. The complainant did not object to having intercourse; with him. INDECENCY CHARGES On two charges of indecent exposure and one of indecently assaulting a girl. Arthur John Warrington, aged 32. a butcher, was committed to the Supreme Court for trial. Warrington (Mr B. J. Drake) pleaded not guilty. He was allowed bail. A third charge against War-: rington of indecent exposure; nn December 15 was dismissed. (Before Mr E. A. Lee, S.M.) PEERED INTO WINDOW I A youth, whose name was; suppressed, pleaded guilty to! a charge of peering into a window by night without lawful excuse on April 28. He was convicted and remanded on bail to May 7 for sentence. THEFT OF RADIO After a party on the evening of April 25, Laurence Anthony Jackson, who was in an advanced state of intoxication, removed a transistor radio worth £23 from the back of a friend’s car, Sergeant S. W. Byers said. Jackson, aged 19, a drainlayer (Mr R. J. Moore), pleaded guilty to a charge of theft. He was convicted and remanded on bail to May 7 for sentence. FOUND ON PREMISES Ernest James Jones, aged 46. and Edward Raymond Kelecher. aged 34, pleaded guilty to charges of being found on enclosed premises without .lawful excuse on April 29. Each was convicted and fined £5, in default seven days’ imprisonment. Sergeant Byers said the men were found asleep on the veranda of the Christchurch East School after spending all their money on drink. Jones also pleaded guilty to a charge of breach of probation at Otematata on February 25. He was convicted and sentenced to 14 days’ imprisonment. DRUNKENNESS Maria Hapakuku, aged 19, a domestic, pleaded not guilty to a charge of being found drunk in a public place at Lyttelton on April 28. Hapakuku, who had been convicted twice of the same offence during the previous six months, was convicted and fined £5, in default of six days’ imprisonment. Hapakuku said she had not been drunk, but had taken an overdose of sleeping pills.
REMANDED Glenda Louise Allen, aged 25, a waitress, charged with using obscene language on Gladstone pier, Lyttelton, on April 28, was remanded ia custody to flay 7. Allen elected trial by jury. Clarence Ralph Wifiton Davey, aged 31, a rubber worker, was remanded on bail to slay 7 on a charge of committing a breach of probation on March 26.
Vernon Lee Crighton, aged 19, a steward, charged with deserting from the Australian Star at Auckland on April 13, "as remanded in custody to May 7. Charged with being idle and
disorderly in that he had insufficient lawful means of support on April 28, Walter Cook, aged 42, a labourer, pleaded not guilty. He was remanded in custody until today. Charged with driving under the influence of drink or drugs on April 28 in St. Asaph street, Alan Allington Austin, aged 43, a storeman, was remanded on bail to May 7. , Terence Joseph Foote, aged 44, a workman, pleaded not guilty to a charge of being found on enclosed premises without lawful excuse on April 29. He was remanded in custody until today. CHARGE DISMISSED A charge against Stephen William O’Rourke of exceedI ing 3o miles an hour in Memorial avenue on December 12 was dismissed without prejudice. O’Rourke, a taxidriver (Mr P. G. S. Penlington), pleaded not guilty. . Traffic Officer C. Fisk said he checked the speed of a taxi driven by O’Rourke at 40 miles an hour in Memorial avenue, a gazetted roadway i of the Waimairi county. Mr Penlington said the prosecution stated the roadway was a gazetted 30-mile-an-hour area, but no actual evi- ; dence in the form of the New Zealand Gazette had been I produced. ‘ From experience he knew the area of roadway from
Grahams road down towards the city to be a gazetted 30-mile-an-hour highway, the Magistrate said, but in dealing with this particular case he could not accept it as such unless definite proof was introduced. “Unless the actual restriction is produced, I cannot accept the prosecution’s case,” he said in dismissing the information. Crutchley, S.M.) CHARGE DISMISSED A charge of dangerous driving in Cambridge terrace on February 4 against John Richard Vivian was dismissed. The Magistrate reserved his decision after evidence was heard on Tuesday. He said yesterday that he had reservations about the defence, but the prosecution had not presented any evidence to the contrary. "As there is some doubt tn my mind, the case is dismissed,”- he said.
