Magistrate’s Court Fined £8 For Failing To Stop After Accident

When a car stopped at the intersection of Moorhouse avenue and Ferry rood on July 13, it was struck by the car following, Traffic Sergeant H. J. McMorran told Mr K. H. J. Headifem, S.M., in the Magistrate's Court yesterday, when James Secular Shand (Mr N. H. Buchanan) pleaded not guilty to changes at careless driving, failure to stop after an accident .and failure to ascertain whether anyone was injured. Sliiand was convicted and fined £5 on the change of careless driving, and £8 on the change of failing to stop after an accident. He was ordered to pay costs on the charge of failure to ascertain if anyone had been injured. DROVE CARELESSLY

Appearing on changes of careless driving and of failure to supply his name and address on July 24, Brian Hay, an apprentice panelbeater, pleaded not guilty. Hay (Mr R. G. Blunt) was convicted on the charge of careless driving and fined £4, with suspension of his Licence for one month. The charge of failing to give his name and address was dismissed.

Breach of a contract to sell an earth excavator was alleged by Cuibitt Wells, Ltd., of Wellington (Mr R. S. D. Twyneham) against Edmond and Son, of Christchurch (Mr J. B. Williams) in a claim for £489 6s damages. The Magistrate gave judgment for the defendant, with costs. Ross W. Davies, an engineer, said he was sent to Christchurch by Cubitt Wells, Ltd., in July, 1962. to look at an excavator owned by Edmond and Son. He told Adam Edmond, the manager of Ed-

mond and Son, that he would buy the excavator subject to approval by his employer. Edmond agreed to selL When approval was given, Edmond refused to sell. The claim was for Loss of usage, the difference between the cost of Edmond's machine and a new one, and the cost of the trip, Davies said. Adam Edmond said he did not think anything final had been arranged with Davies. The Magistrate held that the plaintiff had failed to prove that a contract had been made. £174 DAMAGES A soldier who failed to give way and collided with another car in Moorhouse avenue in May, 1962, was ordered to pay £174 Ils 6d and costs in a civil claim. The plaintiff was Leo Michael Keating, a physiotherapist (Mr G. F. Rea) and the defendant was Leslie Thomas Jaimes Cogger (Mr W. A. Wilson). Mr Rea said the damages sought were for repairs to Keating’s car, and the cost of a rental car used by Keating while his car was being fixed. Mr Wilson said that Cogger admitted flailing to give way. He disputed the amount because as a qualified panelbeater he could have fixed the car himself. His offer to do so was not accepted. The Magistrate said he could not accept that damages should be minimised because Cogger could have done the repairs cheaper and quicker. Keating was entitled to refuse this offer. CIVIL CASES
