No Order For Restitution

PALM. NORTH, May 13. Eighteen months’ imprisonment. with ru order foi restitution of money to the Army Department, was the verdict of Mr D. G Sinclair S.M., when Neil Anderson Marshall, aged 41. appeared for sentence today on a charge of stealing jums of money amounting to £ 1663 19s lOd, the property of the Army Department at Linton Mr H H. Gilliant, appearing for Marshall, said the offences had been over an extended period. Marshall was intelligent, but unde r pressure of debts. He intended making repayment. He had been an executive officer handling money in other directions, and it was with a sense of relief that he had co-operated with the police Detective Sergeant F. Parker said the Army had requested an order for restitution

The Magistrate said there would be no order for restitution. The Army should have taken some steps to prevent the defalcations.

“A person who hopes to get out of debt by gambling cannot be regarded as intelligent." he said. "Regard must be given to the period over which the defalcations were spread and the amount involved while in a position of trust.”
