Magistrate’s Court Fine And Loss Of Licence For Dangerous Driving

Changed with dangerous driving on November 17, George Donaldson, aged 20, a carpenter, was fined £l7 10s, and his driver’s licence was cancelled for one year, by Mr E. S. J. Crutchley, S.M., in the Magistrate’s Court yes* terday. Donaldson (Mr G. T. Mahon), pleaded not guilty.'

Traffic Officer W. J. Noster said he saw Donaldson travelling In Papanui road near Webb street at an excessive speed at 7.20 pan. He gave chase but because of the heavy traffic was unable to get near Donaldson until Heaton street was reached. He checked Donaldson travelling 50 miles an hour before he turned into Blighs road, where his speed was 45 miles an hour. Traffic Officer Noster said he considered the speed dangerous in the circumstances. Donaldson overtook cars in the face of oncoming traffic and at times was well on the wrong side of the road. When stopped Donaldson said he thought he was travelling 30 to 35 miles an hour. Mr Mahon submitted that the speed was not dangerous. Donaldson had a modern car with effective brakes and there had been no evidence of dangerous driving apart from the speed. The Magistrate said a motorist could have moved out from an intersection expecting Donaldson to be travelling something less than 30 miles an hour, or a motorist could have pulled over to the middle of the road before making a right turn, and Donaldson could hardly have avoided an accident while he was passing other cars. BAIL REFUSED

Charged with breaking and entering the premises of the ■Calder Mackay Company, Ltd., 115 Worcester street, on or about April 7, Kenneth Reuben Browne, aged 31, a workman, and Graeme Russell Hancox, aged 21, a storeman, were remanded to April 19.

Senior-Sergeant G. M. Cleary said he strongly opposed bail in the public interest. It was a serious charge, a large sum of money was involved, and there was a chance of the crime being repeated. Leslie James Marsh, aged 17, unemployed, was convicted and remanded on bail to April 19 . when he pleaded guilty to a charge of stealing a camera on March 29.
