Magistrate’s Court Disqualified Driver Fined £56 Further Cancellation

I S.M, in the Magistrate’s : Court yesterday. Lanyon was involved in aa accident |while driving his car some hours before the expiration i of a period of disqualification.
Lanyon was fined £4O for driving while disqualified, £l5 for foiling to report an accident, and £1 for having no warrant of fitness. He pleaded guilty to all charges, and was not represented by counsel.
Lanyon struck a parked car in Cashel street about 1 pm. on October 4. Witnesses saw the car race away after the accident with the three or four occupants laughing, said Sergeant V. F. Townshend. The parked car was extensively damaged. Lanyon’s number was taken by a witness, and when he was first interviewed he denied knowledge of the incident, but later admitted ail offences. The Magistrate warned Lanyon he would be imprisoned if he appeared again on a similar charge. STOLE MONEY Charged with the theft of £4 10b from the bedroom of a friend at Christchurch on January 26, Raymond Gerald Watts, aged 18, a farm hand, was remanded on bail to February 15 for sentence. Sergeant Townshend said that Watts could give no explanation. He noticed the money lying on the bed of his friend whom he was visiting, and was unable to resist the temptation.
STOLE SUITCASE Pleading guilty to stealing a suitcase and contents valued at £3O at Glenavy on January 29, Colin James Davey, aged 19. unemployed (Mr W. A. Wilson), was convicted and remanded on bail to February 15 for sentence. REMANDED Kere Waihapi aged 32, charged with burglary on or about February 3, was remanded in custody to February 15. On a charge of theft as a servant at Christchurch, on or about October 30, Jack Radcliffe, aged 45, an employee of the New Zealand Railways Department. was remanded on bail to February 15.

E. H. Boyce a cartage contractor (Mr H. W. Hunter), faced 10 charges of breaches of driving hours, insufficient rest, and falling to keep a correct time-book.
(The Transport Licensing Regulations say that a heavyduty driver must work no more than five hours and a half without a break, no more than 11 hours in every 24 hours, and must have at least 10 consecutive hours of rest each day.) Traffic Officer L. R. Stringer, prosecuting for the Transport Department, said that an investigation of the firm’s records showed that one driver, J. Brooks, had, during July and August last, exceeded the regulations by some hours on certain days. On July 9 he worked 161 hours, five and a half over the maximum allowed.
Mr Hunter said that on that day the refrigerated van which Brooks was driving on the Christchurch-Invercargill route broke an axle in Timaru. Brooks worked excessive hours to get his load of perishable goods to their destination. On August 31 Brooks worked 17 hours, six hours over the limit, but there again there was a breakdown. Pleas of not guilty were entered on the five charges relating to July 9 and August 31. Traffic Officer Stringer said that Brooks had only six hours’ rest instead of 10 over a period of 24 hours on August 21. The defendant pleaded guilty to this charge, guilty to two further charges of breaches of driving hours, and one of insufficient rest on August 7. and another of failing to keep a correct time-book on September 24. AU these charges related to Brooks.
The Magistrate dismissed all charges relating to July 9 and August 31. He convicted and ordered the defendant to pay costs only on the three charges relating to August 7, imposed a fine of £3 on the insufficient rest charge of August 21, and a fine of £1 on the charge of failing to keep a correct timebook on September 24. FINED £2O Although the case was not a clear one of recklessness, the prohibition against passing on double white lines was absolute, said the Magistrate, fining Maurice Gould, aged 61, a company manager (Mr R. W. Edgley), £l5 for overtaking in an area marked with longitudinal white lines at Highbank on September 22. Gould pleaded not guilty to this charge, but guilty to another of exceeding 55 miles an hour, for which he was fined £5.
Gould said he was following another car which was overtaking and Was unable to get back into line when the other vehicle did so. He was still on the right-hand side of the road abreast of vehicles he was passing as he approached the crest before a dip in the road just past the Highbank railway station. The dip was not deep enough to hide oncoming cars completely, He was sure the road was clear of approaching traffic and continued to overtake. He was doing about 60 miles an hour at the time. HIT VAN Colin Cornelius O’Brien, aged 21. a - hairdresser (Mr G. R. Lascelles), was fined £5 for driving without due care and attention in Little Blenheim road on October 18. He pleaded not guilty. O’Brien, driving home at 4 a.m., struck a parked milk van. overturning it. The owner, Noel Ralph Chambers, said he left the van parked close to the kerb facing south with the side-lights on while he delivered milk to nearby houses. O’Brien said the lighting on the van was not adequate for the conditions. It was raining, and the van was not near street lights. He was travelling about 30 miles an hour and did not see the vehicle until it was too late to avoid it. DROVE WITHOUT CARE It was not a serious case of driving without due care, and the defendant’s lack of attention had probably endangered no-one other than himself, said the Magistrate, fining Arthur David Barnett, aged 19, a radio technician. £5 for driving without due care and attention on the Christchurch-Akaroa road at Halswell on February 6. Barnett, who pleaded not guilty, was not represenetd by counsel.
Traffic Officer J. E. Hume said he saw Barnett’s car travelling towards the city on the main road approaching a five-road intersection at about 45 miles an hour. Without slackening Barnett had swung right into Sparks road, his right-hand wheels almost leaving the road. "At that speed he could not possibly have seen if all roads were clear,” Traffic Officer Hume said.
Barnett said he did not consider his speed excessive. He knew the intersection well, and because of the open country vehicles approaching on any of the roads could be seen.
