Doctor’s Appeal Upheld
(NZ. Press Association) WELLINGTON, October 12. The Court of Appeal in a reserved judgment delivered by Mr Justice Turner today allowed an appeal brought by Harold Bertram Turbott, Dir-ector-General of Health, from an order made in the Supreme Court by Mr Justice Leicester and Mr Justice McGregor granting special leave
to the respondent, Archibald William Stopford Thompson, director of clinical services, to appeal after the expiration of the three months permitted under the rules.
This appeal arose out of an alleged slander made by Turbott in relation to Thompson.
At the trial the jury awarded Thompson £5OO, but
judgment was later entered for Turbott after the trial Judge, Mr Justice Leicester, had delivered a judgment to the effect that Turbott was entitled to the protection of absolute privilege at the time the words were spoken. In the Court of Appeal Mr E. D. Blundell appeared for Turbott, and Mr F. D. O’Flynn appeared for Thompson. r .
