LAND VALUATION COURT
Condition Of Farm Sale To Stand A decision of the North Canterbury Land Valuation Committee approving conditionally the sale of Inverness, a 3272-acre property at Parnassus, to John Columbus O’Donnell Aitken, of Darfleld, has been upheld by the Land Valuation Court. In a reserved decision released yesterday, the Court (Judge Archer and Messrs A A. McLauchlan and W. S. McClintock) disallowed an appeal by the vendor of Inverness, Erik Rutherford, against a condition imposed by the committee. Mr B. McClelland appeared for the appellant, Mr E. A. Young for the purchaser, and Mr N. H. Rawson for tne Crown. "We gather that the vendor’s purpose in appealing was not to, secure the completion of the sale, but rather to enable him to :ake action under his contract against the purchaser,” the Court said.
“The purchaser took no active part in the appeal proceedings, and it was suggested that he was relying on the provisions of the Land Settlement Promotion Act in order to evade his obligations under the contract.”
