Judge’s Ruling At Auckland

AUCKLAND, April 5. A torn will left by a woman who had been mentally ill for many years was upheld at Auckland today by Mr Justice Woodhouse in a reserved judgment. The action for proof in solemn form of the will of Maud Mary de Vere Mills, who died in 1958. had been brought by the Public Trustee (Mr N. Wilson, QC„ and Mr H. F. Murphy) Other parties to the application were the AttorneyGeneral as first defendant, and the Solicitor-General as second defendant.
The first defendant appeared in the interests of a number of charities which would benefit under the will The second defendant appeared for the Crown because the property would go to the Crown if the woman died intestate
The Judge said he had no difficulty in deciding that the will, which was made in 1922. had not been revoked by mutilation as was provided by section 20 of the Wills Act.
