COURT ACCEPTS PLEA
Driver’s Claim To Be Tee-totaller ( N.Z. Press Association) WELLINGTON, Feb. 21. A man who insisted he was a total abstainer and never consumed alcoholic liquor was arrested last night on a charge of driving while intoxicated in Jervois quay. He was Albert Arthur Lusty, aged 55, a wool dealer. The charge was dismissed by Mr M. B. Scully, S.M., m the Magistrate's Court today without any evidence being called for the defence by his counsel, Mr G. C. Kent. Lusty pleaded not guilty. Traffic Officer A. C. Summings said he saw Lusty’s car driven erratically. It stalled twice. Lusty smelt of liquor and was taken to the police station. Sergeant L. M. Stevens said he caught a faint smell of liquor on Lusty. He understood Lusty had been allowed to drive home after being examined by a doctor, who found no evidence of liquor.
