U.S. FRAUD CASE
Rejection By Judge fN.Z.PA.-Reuter—Copyright) ORLANDO (Florida). July 13. A United States Federal Judge today rejected the Federal Government’s mail fraud case against the Teamsters’ Union president, Mr J. R. Hoffa, and two associates. The prosecution had alleged that Hoffa, James Lower, and Robert E. McCarthy, jun„ had used the mails, telegraph and telephone lines to defraud union members by promoting real estate development in Florida with union funds. A Federal District Judge, Joseph P. Lieb, dismissed the suit on the grounds that the grand jury which indicted the three men had been selected improperly. In spite of the decision, the Attorney-General (Mr Robert Kennedy) today indicated the Government would press its case that Hoffa and his two associates misused about 500,000 dollars in union funds on a real estate development firm which went bankrupt. Mr Kennedy said the Government could either appeal to a higher court to reverse today's decision, or could re-submit its csss to a new grand jury.
