JUDGMENT ENTERED
Claim For Car Judgment for Namco Furniture, Ltd., of Auckland, in a claim for possession of a car worth £llOO against Collin Weils Hitchcock, formerly a salesman of toe company, was entered by Mr Justice Macarthur in the Supreme Court yesterday. Mr J. R. Woodward, for the plaintiff company, said counsel had agreed to waive the company’s claim for £ 100 damages provided the £4O 10s costs of storage of toe car under a Court order arising from interlocutory pleadings was included in the cos's to be awarded to the plaintiff company against the defendant as a necessary disbursement. Mr R. S. D. Twyneham said he would resist toe claim for damages but could not resist Mr Woodward's application for £4O 10s as a disbursement. Mr Twyneham agreed with his Honour that toe plaintiff company was entitled to some damages but that the amount of damages could be argued. His Honour entered judgment. giving an order for the plaintiff to have possession of toe Austin A 55 car subject of toe action, with costs as on a claim of £lOOO. plus judgment by consent in the sum of £4O 10s. being storage of the car. His Honour allowed witness fees and expenses for the plaintiff, to be fixed by toe Registrar, plus £5 5s for part of an extra day. He.
