DAMAGES CLAIM

Jury Assesses £BB6l (NZ. Press Association) AUCKLAND, June 14. In a majority verdict an Auckland jury after a five and a half hour retirement assessed damages amounting to £BB6l 12s Id in favour of John Henry Peter Wilks, a clo'hing manufacturer, against the Mount Albert Borough Council and Martin Francis Synott and John Cooney, contractors. Mr Justice Boys, who presided at the five-day hearing, deferred entry of judgment for 14 days to enable defence counsel to consider the legal effect of answers given by the jury to issues put to it. The claim arose from severe injuries suffered by Wilks when his car struck the central pylon of a railway overbridge in April, 1959. Wilks claimed roadwork in the vicinity created a trap for vehicles. Wilks had claimed general damages of £l2 500 and special damages of £4094 15s 6d. Tlie jury assessed general damages of £9OOO and special damages of £3094 15s 6d, making a total of £12.094 15s 6d, but reduced that amount by 35 per cent, upon finding Wilks guilty of contributory negligence in failing to keep a proper lookout.
