Magistrate’s Court House-Breaking Charge Dismissed By Justices

A charge against Ronald i Charles O'Connor, aged 31, a steward, of breaking and I entering the home of Walter Reginald Clough on February 20, was dismissed by Messrs J. R. Smith and R. H. Harris, Justices of the Peace, in the Magistrate’s Court yesterday. Mr S. H. Wood appeared for the accused, and Senior-Sergeant G. M. Cleary prosecuted;

Clough, who lives at 20 Glade avenue, Avonside, said that when he and his wife returned home at 11.30 p.m. on February 26 after heing out since about 6 p.m., |he found finger marks on the inside of one of the newly I painted kitchen window ‘frames. He discovered that ; his wife’s watch, valued at £22, was missing. Detective E. H. Stevens said he went to the house that night “It was obvious from the marks, both inside and outside the window, that someone had entered through it,” he said. The next day photographs of the finger prints were taken by the official police photographer. Sergeant H. F. Lissette, who is in charge of the criminal registration section of C. 1.8. headquarters iti Wellington, said he received a negative of the marks on the window and a copy of the accused’s fingerprints. "I have no doubt that the prints are identical and were made by the same person,” Sergeant Lissette said. Detective G. I. Rodgers said he interviewed ■ the accused on April 21 and arrested him. The accused denied knowledge of the offence. After a short adjournment the Justices dismissed the charge. (Before Mr A. P. Blair, S.M.) TRESPASS

Louis Albert Upton, aged 56. a workman, was fined £1 on a charge of wilful trespass on the premises of D, H. Brown and Son. Ltd., Moorhouse avenue, on Tuesday. He pleaded guilty. Sergeant Townshend said that Upton went to his former place of employment to collect wages owing to him, and he had to be ejected by a constable. When he was told he would not get his wages until Thursday, which was the firm’s pay day, he refused to leave until he was given his money. Upton said to the Magistrate that under the union rules he was entitled to his money straight away. DRUNKENNESS James Boyd Moore McLuckie, a seaman, was fined £2 for being found drunk in Worcester street on Tuesday. He pleaded guilty. Sergeant V. F. Townshend said that McLuckie had one previous conviction for drunkenness within the last six months. CHILD NOT SENT TO SCHOOL For failing to send his child to school since April of last year John Nicholls was fined £S. Mr G. R. Lascelles, who appeared for the Canterbury Education Board, said that the child was now aged 14. REMANDED • Monica Emily Tuanui. aged 22, a domestic, was remanded on ball to May 25 on a charge of stealing £3O on May 16. BUILDING BREACH

On a charge of departing from the particulars of a building permit on January 10 Presha Distributors, Ltd., were fined £5. Mr G. R. Lascelles appeared for the Christchurch City Council.

The defendant was represented by Mr P. J. McAloon.

OPEN AFTER HOURS Alan Bryan McGillivray was fined £2 for having nonexempted goods displayed after hours in his mixed business shop in St. Asaph street on March 16. RUBBISH ON ROAD Robert Winston Smith was fined £5 for leaving rubbish on a public road on March 1. UNLICENSED RADIOS For having unlicensed radio receivers Josephine Jane Davy and Ngaire Grey were each fined £2. NO INCOME RETURNS William George McCallum and Mary Elizabeth McCallum were fined £6 on two joint charges of failing to furnish income returns on August 7 last year. On separate charges each was fined £2.
