ASSESSMENT OF DAMAGES
75 Per Cent. Reduction

(New Zealand Press eAssociation) WANGANUI, Nov. 22. A jury in the Supreme Court at Wanganui today assessed damages at £13,814 2s in a case in which a motor-cyclist claimed damages from an estate and a farmer for injuries suffered when his motor-cycle struck a cow on the Nukumaru straight on January 19, 1959. However, the jury found that the plaintiff was guilty of contributory negligence, and reduced the amount by 75 per cent. The Chief Justice (Sir Harold Barrowclough) reserved the matter for 21 days to enable defence counsel to lodge written application for any relief to which they considered they were entitled. The plaintiff was Robert Kirkland, formerly a carpenter but now a splint-maker at the Wellington Hospital. The first defendant was Bernard Hammersley, as executor of the estate of Patrick Forrester, who was in charge of the stock at the time of the accident. The second defendant was Samuel Bland Wilson, a termer. of Nukumaru. the owner of the cattle.
The plaintiff claimed £15.000 general and £Bl4 2s special damages.
