PUBLIC NOTICES CHARITABLE TRUSTS ACT. 19W IN THE MATTER of an applicatl“ by THE ASHBURTON HIGH SCHOOL BOARD established under and incornorated by the Ashburton High School Act ICTS to vary the purposes of a Trust created pursuant to the Will of the late Robert Bell deceased and known as the ROBERT BELL MEMORIAL SCHOLARSHIP. Notice is hereby given pursuant to Section 36 of The Charitable Trusts Act 1957 that the above described Board has applied to the Supreme Court at Christchurch for approval of a Scheme for the disposition of the Robert Bell Memorial Scholarship. The present conditions of tne Trusts in respect of the said Scholarship are as follows: I FURTHER GIVE AND BEQUEATH to the Board of Governors of the Ashburton High School the sum of One Thousand Pounds (£1000) UPON TRUST to invest the same and to apply the annual income to provide from time to time a Scholarship at Canterbury College for three years or such greater or lesser period as may be provided by the College as the requisite period for qualifying for the degree of Journalism. The holding of a scholarship arising from this bequest shall not disqualify the holder from participating in the scholarship already instituted by me at Canterbury College and known as “The Robert Bell Scholarship" AND I DECLARE that the receipt of the Treasurer or other proper officer of the Ashburton High School shall be a sufficient discharge to my Trustee for the payment of the said legacy without It being necessary for it to see to the application thereof. . Particulars of the said Scheme are as follows: — I The conditions of the trusts derived from a bequest under the Will of the late Robert Bell deceased and known as the "Robert Bell Memorial Scholarship” are hereby revoked ana the following conditions are hereby substituted: 1. THERE shall be scholarships to be known as “Robert Bell Memorial Scholarships” ana the following provisions shall apply with respect thereto. 2. TO qualifiy for an award of. a scholarship a candidate must satisfy all of the following conditions: (a) The candidate must be a pupil or former pupil of the Ashburton High School and must have attended the said school during the year immediately preceding that in which the award is made. (b) He or she must have passed the University Entrance examination. (c) He or she must satisfy the selection committee hereinafter mentioned of his or her intention, should he or she be awarded a scholarship, of commencing the course for a Degree of Bachelor of Arts (including English to Stage I) at the University of Canterbury at the beginning of the academic year immediately following such award. 3. THE term of each scholarship shall be three years. 4. THERE shall be payable to the holder of each scholarship an annual sum of £3O, subject however to the provisions of Clause 5 hereof. 5. THE Board may at its discretion vary the amount of the Scholarship from time to time after taking into consideration the amount of accumulated and accruing income available from the fund.

6. THE selection committee shall comprise the Chairman for the time being of the said Board, the Principal for the time being of the said School and a member of the said Board appointed by the said Board each year for such purpose. 7. AWARDS of scholarships shall be made not later than the end of February in each year and one or more scholarships may be awarded in each year as funds will admit. 8. THE selection committee shall not be obliged to award a scholarship in any year and may withhold the award of a scholarship on such grounds as it thinks fit. 9. EACH holder of a scholarship shall throughout his or her tenure of the same comply with the conditions of the course laid down by the University of Canterbury for the Degree of Bachelor Of Arts (including English to Stage I) and shall make satisfactory progress in his or her course. The Board may from time to time review the progress being made by a scholarship holder and may, at its discretion, reduce the amount* payable thereunder or terminate the same. II THE reasonable expenses of or Incidental to preparing and advertising this Scheme shall be paid out of and shall be a charge upon the Trust Fund held by the said Board to provide the said scholarships. A copy of the said Scheme has been filed in and may be inspected at the Registry of the said Court. It is proposed that the application for approval be heard by the Supreme Court at Christchurch on Wednesday, the 9th day of March, 1960. Any person desiring to oppose the said Scheme is required to give written notice of his intention to do so to the Registrar of the Supreme Court at Christchurch and to the Ashburton High School Board and to the Attorney-General not less than seven clear days before the date proposed for the hearing of the application.
