Mr Cooke’s Reference To “Mistake”

(New Zealand Press Association) WELLINGTON, Sept. 22. During the hearing of Holloway’s case against Truth (N.Z.) Ltd., he had been surprised to hear counsel for Holloway (Mr W. E. Leicester) presenting submissions which he had presented himself earlier -in the case, counsel for “Truth” (Mr R. B. Cooke) told the Court of Appeal today. It appeared that Mr Leicester had taken a note of his colleague’s submissions and then mistaken them for notes of his own submissions, Mr Cooke said. Mr Leicester chuckled as Mr Cooke remarked: “I must say he presented them with more force and dignity than I would have done.”

Mr Cooke recalled that Mr Leicester appeared to notice his error, because he asked that the submissions be withdrawn. He mentioned it. said Mr Cooke, because the trial Judge commented on the submissions in his address to the jury. Mr Justice Gresson called on counsel to clarify the matter in consultation before the Court resumes tomorrow morning.
