Boy Convicted Of Murder
(Rec. 7 p.m.) MELBOURNE, Sept 17. Barry Frederick Darby, aged 14, was found guilty yesterday of the murder of Leonard William Lewis, aged 16, a fellow student and captain and head prefect of Pakenham Consolidated School, Gippsland, on July 6. A Melbourne Criminal Court jury reached its verdict in 20 minutes after a three-day trial in which evidence was given by other students that Darby had been tormented by Lewis before he made up his mind to shoot Lewis. Mr Justice O’Bryan ordered Darby to be detained until released by the Government Earlier, the Judge told the jury, before it retired, of the law which provides that persons under 18 are not sentenced to death. Darby, slightly built showed no sign of emotion at the verdict. His parents, who live on a 55acre farm in Nar-Nar-Goon, were in the gallery. The Judge ruled that the provocation, of which other boya testified Darby was a victim, did not legally justify a reduction of the crime from murder to manslaughter.
