Magistrate’s Court “Abusive” Youth Fined On Six Traffic Charges

An 18-year-old youth, who was “cheeky, abusive and in a fighting mood” when he was stopped when riding a friend’s motor-cycle after a chase by a traffic officer, was fined and ordered to pay costs, totalling £25, when he was convicted on six traffic charges by Mr Raymond Ferner, S.M., in the Magistrate’s Court yesterday. He is John Miller, who was unemployed at the time the offences were committed. Traffic Officer K. O. J. Smith said that at 11.10 p.m. on April 7 he was standing at the intersection of Colombo street and Moorhouse avenue when he saw a motor-cycle, without lights, travelling towards him south along Colombo street at a speed which he estimated was in excess of 30 miles an hour. At the intersection the motorcycle, which was ridden by Miller and had a pillion passenger, almost hit another motor-cycle which was turning right, when Miller rapidly overtook it, Traffic Officer Smith said. As Miller turned right into Moorhouse avenue he called on him to stop but Miller took no notice. Traffic Officer Smith said he gave chase to Miller who accelerated to between 40 and 45 miles an hour. This speed was maintained over the Durham street intersection and when Miller approached Montreal street he slowed down and when turning into Montreal street, south, he went over the centre line on to the wrong side of the road. Miller was stopped just over the railway crossing but he refused to give his name and address, said Traffic Officer Smith. He radioed for assistance and within a short time Traffic Officers Baldwin and Warren arrived. Miller eventually gave his name and said he lived in Addington. The motor-cycle was owned by the pillion passenger, Robert William Smith, of Pines Beach, Kaiapoi. Neither Miller nor Smith were wearing a safety helmet. Miller said he could not produce his driver’s licence as he had lost it at a party at Nelson 10 months before and had not renewed it. Traffic Officer Smith said. He admitted that he was restricted to L plates by the licence which had been issued by the Nelson City Council.

The traffic officer was very pleased he had two-way radio and was able to summon assistance of other traffic officers who were on the spot ip a very short time, said Chief Patrol Officer J. Brown, who prosecuted for the Christchurch City Council. It was not usual for so many charges to be laid against one person but in this case it was warranted. Miller, who did not appear, was fined £3 for having insufficient lights, £3 for exceeding 30 miles an hour, £2 for not wearing a safety helpiet, £2 for carrying a pillion passenger not wearing a safety helmet, £1 for failing to carry a driver’s licence and £3 for carrying a pillion passenger when restricted to L plates.

FAILED TO SUPPLY INFORMATION For failing to supply the name and address of the driver of a car at the date and time when an alleged offence was committed Thomas Walker, the registered owner of the car, was fined £lO. He pleaded guilty. Traffic Officer Lovell had placed a traffic offence notice on a car parked in a time expired metered space in Manchester street on February 20 and no reply had been received. On February 27 a registered letter had been sent to Walker, the registered owner of the vehicle, but no reply was received, said Traffic Officer M. H. Loughlin. The information had to be supplied within 10 dikys of the offence under section 49 of the Transport Act 1949. TAXI LEFT UNATTENDED A taxi driver, John William Elskamp, who left his car parked on the rear of a taxi stand in Cashel street while he went to buy a birthday present, was fined £1 10s on a charge of failing to remain in attendance on a taxi on a stand. Elskamp told the traffic department that he had been detained, said Chief Patrol Officer Brown. Traffic Officer J. R. Krippner said he checked Elskamp’s taxi on the end of the four-car stand in Cashel street between Manchester and High streets, for 10 minutes. There was a number of taxis moving about at the time. REMANDED

Wally Tuhi, aged 30 (Mr G. R. Lascelles) was remanded to June 8 on a charge of assaulting Constable W. A. Cromie in the execution of his duty at Little River on June 1. Tuhi was granted bail at £lOO with one surety of £lOO and was ordered to report daily to the police. Arthur Charles Hooper, aged 53, a caretaker (Mr B. A. Barrer) was remanded to June 15 on a charge of driving under the influence of drink or drugs on May 30. He was granted bail at £25 with one surety of £25.

James McAteer Harbridge, aged 37, a company manager (Mr R. Twyneham) was remanded to June 15 on a charge of driving a car in Manchester street on May 30 when under the influence of drink or drugs. He was granted bail at £25 with one surety of £25.

Joan Ivy Agnes Orlowski, aged 19, was remanded in custody to June 8 on a charge of converting a woman’s bicycle valued at £l5 on April 7. Suzanne Miriam Jordan, aged a shop assistant, was remanded in custody to June 8 on charges of assaulting Natalie Adrienne Hughes on March 8, the theft of £3 from Arthur Thomas Smith on May 25 and the theft of a sheath frock and skirt valued at £5, the property of Olive Amy Forno between April 2 and April 6. A Connecticut motorist who paid a two-dollar parking fine with in cheque made out to the “West Hartford Police Gestapo” was fined an additional 50 dollars.
