Discretionary T rust To Be Formed

The formation of a discretionary trust to make adequate provision to Herbert John Thomas from the estate of his wife was ordered by Mr Justice Haslam in the Supreme Court yesterday. The estate comprised £4OO in cash, £75 of which the plaintiff claimed was his. and furniture and effects worth £162. which Thomas also claimed belonged to him, said Mr D. H. God-**ey. Under the will he was left the income on the entire estate, and the residue went to the testator’s seven nephews and nieces.

The plaintiff, who was a widower aged 87, claimed the whole estate on the grounds that he was the only person entitled to claim under the act and had a paramount claim to maintenance.

Mr B. G. Dingwall, who appeared for the remaining beneficiaries, and Mr H. S. Thomas, for the Perpetual Trustees Estate and Agency Company, Ltd., agreed to the formation of a discretionary trust to provide maintenance for the plaintiff and to preserve the estate for the other beneficiaries.
