WAR DESERTION CHARGE

Vittorio Mussolini, eldest son of the Italian dictator, and now a resident of Buenos Aires, was expected today to return to Italy to stand trial on an Italian Air Force desertion charge, according to the American Associated Press. The case is expected to come up in January. The American Associated Press said that the charge dated back to 1943 when Benito Mussolini was overthrown. Vittorio Mussolini was a young Air Force captain at the time, and on a 15-day leave. Instead of returning to his unit, he dropped out of sight and eventually made his way to Argentina. A Florence Military Court tried hirfi in absentia in 1951 and found him guilty of desertion. He was given a three-year suspended sentence. Mussolini appealed and last March the Supreme Military Tribunal in Rome threw out the conviction and ordered a new trial. Yesterday, the Florence Military Prosecutor formally ordered the sentence to be stricken from the official records. If Mussolini fails to appear personally before the Court for a retrial, the Court can reinstate the old sentence without proceedwith a full new hearing, the American Associated Press said.
